Constitutional aspects of coping with totalitarian past in selected countries

Abstract:

Cílem této práce je analýza zakotvení základních práv a svobod do právního řádu České republiky (popř. Československa), v podobě přijímání nové právní úpravy. V dalších kapitolách se diplomová práce věnuje přístupu komunistů po roce 1989 ke své vlastní minulosti, ale i přístupu zákonodárců. Dále také některým způsobům vyrovnání se nových státních představitelů po roce 1989 se zločiny a nespravedlnostmi páchanými v rámci starého totalitního režimu, zasahujícími do ústavně zaručených práv a svobod (restituce, lustrace, rehabilitace). Tyto kroky mohly být v některých případech velmi kontroverzní, a tak je dalším cílem této práce analyzovat kontrolu ústavnosti přijaté legislativy, stejně jako kontrolu souladu zásahů státních orgánů a soudů s ústavně zaručenými právy a svobodami. Dále práce obsahuje analýzu vývoje nucené práce v od roku 1948, až do roku 1989, a následnou změnu v podobě jejího zákazu. V závěru práce rozebírá odpovědnost za zločiny spácháné za minulého režimu, ovšem z politických důvodů nepotrestané.

Abstract:

The aim of this work is to analyze the embedding of fundamental rights and freedoms in the legal order of the Czech Republic (or Czechoslovakia), in the form of adopting a new legal arrangement. In other chapters, the thesis is giong over the approach of the communists after 1989 to their own past, but also over the approach of the legislators. Furthermore, the thesis breaks down some ways of coming to terms with the crimes and injustices committed by the old totalitarian regime, interfering with constitutionally guaranteed rights, by the new state representatives after 1989 and freedoms (restitution, lustration, rehabilitation). These steps may have been very controversial in some cases, so another goal of this work is to analyse the constitutionality control of the adopted legislation, as well as the control of the compliance of interventions by state authorities and courts with constitutionally guaranteed rights and freedoms. Furthermore, the work contains an analysis of the development of forced labor in the period from 1948 to 1989, and the subsequent change in the form of its prohibition. In the end, the thesis analyses the responsibility for crimes committed under the previous regime, which, however, went unpunished for political reasons.
