Legal Aspects of the Current Account in the Czech Republic

Abstract:

Cílem této bakalářské práce je seznámení s právními aspekty bankovní smlouvy o účtu na území České republiky po rekodifikaci zákona č.89/2012Sb., občanského zákoníku, jehož účinnost nastala k 01. 01. 2014 a přináší zásadní změny v koncepci a pojetí soukromého práva. V první části je popsán historický vývoj platebního styku na finančním trhu a vývoj vzniku komerčních bank v České republice po roce 1989 spolu s jejich právním vymezením. Dále jsou specifikovány možnosti vzniku a zániku smlouvy o platebním účtu mezi fyzickou osobou občanem a bankou. Jsou analyzovány možnosti a hlavně úskalí dopadů dispozičního práva na obslužnost platebního účtu ve specifických životních situacích, jako je úmrtí majitele účtu či exekuční příkaz přikázáním pohledávky z účtu. Charakterizovány jsou dopady těchto situací v praxi. Přiblíženo je také dědické právo jako nositele nových institutů v rámci dědického řízení.

Abstract:

The aim of this bachelor work is the familiarity with the law aspects of the bank contract on the account agreement in the area of the Czech Republic after the recodification of the law number 89/2012Sb., the code of the Civil law that became operative on 01. 01. 2014. It brings principle changes in conception and approach to Private law. Firstly there is described historical development of the account intercourse on the financial market and establishment of the commercial banks in the Czech Republic after the year 1989 together with their law limits. Next there are specified possibilities of the inception and inoperation of the account agreement between physical person (client) and the bank. There are analyzed possibilities and mainly proposition of the impact of the disposal right at the account attendance in specific living situations, as the death of the account owner or execution order commanded by the outstanding debt from the account. There are impacts of those situations described in practice. It also Rigft of succession drawn near as a bearer of the new institutes in the rank of the succession proceedings.
