Limitation of Time as Circumstance causative Conclusion of Liability

Abstract:

Tématem této bakalářské práce je promlčení trestnosti jako okolnost způsobující zánik trestnosti. Jedná se o závěrečnou práci při studiu na Právnické fakultě Masarykově univerzity, Katedře trestního práva. Vedoucím práce je doc. JUDr. Josef Kuchta, CSc. Práce odevzdána na jaře 2014 a má celkem 65 stran. Obsahem bakalářské práce je v teoretické části právní rozbor problematiky trestní odpovědnosti, historie promlčení na našem území, rozbor zániku trestní odpovědnosti účinnou lítostí a promlčením, porovnáni těchto dvou institutů trestního práva a porovnání promlčení s úpravami jiných států. V praktické části následuje kriminologický výzkum zpracovaný formou dotazníku u policistů Policie České republiky zařazených na obvodních odděleních Územního odboru Hradec Králové a na Dálničním oddělení Pravy. V závěrečné části jsou uvedeny možné právní změny promlčení a zhodnocení současné právní úpravy.

Abstract:

The theme of this thesis is the limitation is punishable as a factor causing the demise of criminality. This is the final work while studying at the Faculty of Law, Masaryk University, Department of Criminal Justice. Supervisor is Assoc. JUDr. Josef Kuchta, MD. Entries submitted in the spring of 2014, and has a total of 65 pages. The content of this bachelor thesis is a theoretical analysis of the legal issues of criminal liability, limitation of history in our country, analysis of extinction of criminal liability of repentance and are time-barred, the comparison of these two institutes of criminal law and comparison with the limitation of other countries. In the practical part follows criminological research done in the form of a questionnaire by the Czech police officers assigned to the district departments of the Territorial Department of Hradec Králové and the highway department rights. The final section provides possible legal changes prescription and assessment of the current legislation.
