Tool Marks Examination - Methods of Securing and Examining Mechanoscopic Traces

Abstract:

Diplomová práce se zabývá mechanoskopií, která patří mezi méně známým oborem kriminalistické techniky. Tato skutečnost vede orgány činné v trestním řízení k neopodstatněnému podceňování mechanoskopických stop z hlediska jejich taktického i procesního využití jakožto důkazního prostředku v trestním řízení. Nízká povědomost o zákonitostech vzniku a významu mechanoskopických stop pak vede i k chybám na místě činu při jejich vyhledávání a zajišťování. Z tohoto důvodu tato práce nejprve představuje celé odvětví kriminalistické mechanoskopie – její historii, objekty zkoumání, ale i způsoby páchání trestné činnosti s názorným demonstrováním vzniku kriminalistických stop. Stěžejní část diplomové práce je věnována metodice zajišťování mechanoskopických stop a nástrojů. Zajišťování mechanoskopických stop zde není popsáno jen z hlediska kriminalistické techniky, ale i kriminalistické taktiky a rovněž i z pohledu procesního. Další část práce se zabývá metodami využívanými při kriminalistické mechanoskopické expertize, ale i problematikou znaleckého zkoumáním obecně. V poslední části je pak na stanovených hypotézách zjišťován taktický a procesní význam mechanoskopických stop a mechanoskopické expertizy pro trestní řízení. Hlavním cílem práce je tedy ucelené představení metodiky zajišťování jednotlivých druhů mechanoskopických stop a nástrojů. Vedlejší cíl pak spočívá v uvedení využívaných kriminalistických metod, kterými jsou mechanoskopické stopy a nástroje zkoumány a dokázat jejich taktický a procesní význam pro trestní řízení.

Abstract:

The diploma thesis deals with tool marks examination as a less known field of forensic techniques. This fact often leads the law enforcement authorities to unjustifiably underestimate the mechanoscopic traces in terms of their tactical as well as procedural use as evidence in criminal proceedings. The low awareness of the rules of origin and the importance of the mechanoscopic traces also leads to mistakes at the crime scene during their search and secure. For this reason, this work firstly presents the entire branch of forensic tool marks investigation and examination - its history and objects of investigation, but also the ways of committing crimes with demonstration of emergence of crime scene traces. The main part of the diploma thesis is dedicated to the methods of securing mechanoscopic traces and tools. The securing of mechanoscopic traces is not described only from the point of view of forensic techniques but also from the point of view of investigative tactics and procedures. The next part of the thesis deals with methods applied in forensic tool marks examination as well as with the issue of expert examination in general. The last part then with the use of stipulated hypotheses provides findings regarding tactical and procedural significance of the mechanoscopic traces and the tool marks investigation and examination for the criminal proceedings. The main aim of the thesis is therefore a complete presentation of the methods of securing various types of mechanoscopic traces and tools. The secondary aim is to list forensic methods by which the mechanoscopic traces and tools are investigated, and prove their tactical and procedural importance for the criminal proceedings.
