Abstract:

Zdravotní péče představuje soubor pracovních činností s cílem prodloužit život a zvýšit kvalitu života pacienta. Musí být poskytována za předem stanovených podmínek a jen za předpokladu, že bude pacient o rizicích a následcích léčby dostatečně informován. Informování pacienta výrazným způsobem zapojuje pacienta do procesu léčby, zvyšuje jeho právní a zdravotnické vědomí, ale zároveň poskytuje ochranu ošetřujícímu lékaři před možnými právními následky. Samozřejmě i v případě informovaného souhlasu existují určité zákonné výjimky. Předkládaná diplomová práce se zabývá právními aspekty zdravotní péče a hospitalizace pacienta bez jeho souhlasu. Cílem práce je definovat základní pravidla, na jejichž základě je možné zdravotní starostlivost bez souhlasu poskytnout a posoudit, zda stávající právo i praxe na území České a Slovenské republiky tato pravidla respektuje. V teoretické části se práce zaměřila na vymezení základních pojmů v souvislosti s poskytnutím zdravotní péče bez souhlasu pacienta. Důraz byl kladen především na výjimky z informovaného souhlasu obsažené v zákoně o zdravotních službách. Na teoretickou část navazuje část experimentální, která metodou komparace porovnává právní úpravu Slovenské a České republiky v kontextu zvoleného tématu. Praktickou část předkládané práce doplňuje De lege ferenda, tedy budoucí právní úpravy zákonů. V závěru jsou s využitím komparativních metod formulovány rozdíly v právní úpravě zákonů Slovenské a České republiky.

Abstract:

Healthcare is a set of work activities aimed at prolonging life and improving the quality of life of a patient. It must be provided under predetermined conditions and only if the patient is adequately informed about the risks and consequences of treatment. Informing the patient significantly involves the patient in the treatment process, increases his legal and medical awareness, but at the same time provides protection for the attending physician from possible legal consequences. Of course, even with informed consent, there are some legal exceptions. The submitted diploma thesis deals with the legal aspects of health care and hospitalization of a patient without his consent. The aim of the thesis is to define the basic rules on the basis of which it is possible to provide health care without consent and to assess whether existing law and practice in the Czech and Slovak Republics respects these rules. In the theoretical part, the work focused on defining the basic concept in connection with the provision of health care without the consent of the patient. Emphasis was placed primarily on the exceptions to informed consent contained in the Health Services Act. The theoretical part is followed by an experimental part, which compares the legislation of the Slovak and Czech Republics in the context of the chosen topic by the method of comparison. The practical part of the presented work is supplemented by De lege ferenda, i.e. future legal regulations of laws. In the end, differences in the legal regulation of the law of the Slovak Republic and the Czech Republic are formulated using comparative methods.
