Liabilities of debtors in bankruptcy (legal proceedings ended by December, 31st 2012)

Abstract:

Bakalářská práce je zaměřena na základní charakteristiku insolvenčního řízení. V teoretické části jsou v kostce popsány jednotlivé subjekty, nastíněny rozdíly mezi jednotlivými druhy pohledávek a definována majetková podstata dlužníka. Závěr této části je věnován samotnému průběhu insolvence -- od podání návrhu přes rozhodnutí o úpadku až po zpeněžení majetku a sepsání konečné zprávy. Praktická část je orientována směrem ke statistickému srovnání všech konkurzem skončených insolvencí v roce 2012. Detailně rozloží jednotlivá řízení dle krajů a právní formy dlužníka. Graficky znázorní procentuální výši uspokojení věřitelů, dobu procesu, druh a dobu podnikání. A to vše jak v absolutní, tak i relativní výši.

Abstract:

This bachelor thesis is focused on the main characteristics of bankruptcy. In the section devoted to the theoretical facts, there is a short description of individual subjects and differences between the particular types of receivables as well as the essence of debtor's estate are described. The end of this section is dealing with the legal procedure of bankruptcy -- from submitting the proposal through declaring bankruptcy to monetization of all debtor's assets and drafting of the final report. The analytical part of this work is focused on the statistical comparison of all legal proceedings ended by December 31, 2012. Those will be analysed in detail by territory and by the legal form of the debtor's. The percentage of the satisfaction of the debts, the length of the legal action and the type and period of running a business of the debtor will be illustrated using graphs. All of them on an absolute and a relative basis.
