Organ transplantation as an international regime

Abstract:

Transplantace orgánů je zavedený komplexní léčebný postup dávající šanci vážně nemocným pacientům se selhávajícím orgánem na záchranu života. Přínos těchto procedur je nepopiratelný, avšak naráží na nedostatek vhodných dárců. Velká poptávka po transplantacích stále vytváří prostor pro mezinárodní obchod s orgány a transplantační turistiku. Ve snaze efektivně alokovat orgány a zabránit nelegálním transplantacím se státy uchylují k různým formám mezinárodní spolupráce. Cílem práce je ověřit zda existuje mezinárodní režim pro transplantace orgánů za předpokladu režimní situace a pokročilé mezinárodní spolupráce. K posouzení existence mezinárodního režimu pro transplantace orgánů bude přistoupeno jako k případové studii a použito kvalitativní metody shody. V práci se potvrdila existence mezinárodního režimu pro transplantace orgánů, neboť se podařilo nalézt vzor struktury a fungování charakteristický pro mezinárodní režim.

Abstract:

Organ transplantation is an established comprehensive treatment procedure that gives seriously ill patients with failing organs the opportunity to save their lives. The benefits of these procedures are undeniable, but there is a shortage of suitable donors. The high demand for transplants still creates space for international organ trade and transplant tourism. In an effort to allocate organs effectively and prevent illegal transplants, states are resorting to various forms of international cooperation. The aim of this work is to verify whether there is an international regime for organ transplantation, given the regime situation and advanced international cooperation. The assessment of the existence of an international organ transplantation regime will be approached as a case study and qualitative compliance methods will be used. The work confirmed the existence of an international regime for organ transplants, as it was possible to find a pattern of structure and functioning characteristic of the international regime.
