Cyber Operation as Armed Attack under International Law

Abstract:

Tato diplomová práce s tématem Kybernetická operace jako ozbrojený útok dle mezinárodního práva se zabývá analýzou možnosti považovat kybernetickou operaci za ozbrojený útok ve smyslu článku 51 Charty OSN. Nejprve podrobně řeší problematiku aplikace mezinárodního práva veřejného, ve vztahu ke kyberprostoru, s důrazem na využití Tallinského manuálu. V druhé části vytváří modelové situace, na základě známých kybernetických incidentů, na které následně aplikuje právní rámec diskutovaný v první části.

Abstract:

This thesis on Cyber Operation as Armed Attack under International Law deals with the analysis of possibility to consider cybernetic operation as armed attack in accordance with Article 51 of the UN Charter. The first part of the thesis is concerned with the applicability of international law to the cyberspace, with emphasis on use of the Tallinn Manual. The second part then creates model situations based on well-known cybernetic incidents in order to apply the legal framework from the first part of the thesis to them.
