Legal Aspects of the Use of a Weapon by the Police Officers

Abstract:

Za téma bakalářské práce jsem si zvolil Právní aspekty použití zbraně příslušníkem Policie České republiky. Ve své práci se v úvodu věnuji vymezení pojmu zbraň a jeho místu v právním řádu České republiky. V další kapitole se věnuji obecnému vymezení použití zbraně, jehož základ je v Ústavním zákoně č. 1/1993 Sb., Ústava České republiky a v Usnesení předsednictva České národní rady č. 2/1993 Sb., o vyhlášení Listiny základních práv a svobod. A dále v nově účinném Zákoně č. 40/2009 Sb., trestní zákoník, kde se zaměřuji na instituty krajní nouze, nutné obrany a oprávněného použití zbraně. V případě institutu nutné obrany upozorňuji zákonodárce na vážný nedostatek, tedy odlišné znění tohoto ustanovení v přestupkovém (správním) a trestním právu. V další části se zabývám jednotným ozbrojeným bezpečnostním sborem Policií České republiky, jejímu postavení a dále použití zbraně policistou, kde jsem se zaměřil především na ústavní zakotvení, podmínky použití zbraně dle Zákona č. 273/2008 Sb., o Policii České republiky a dle interních normativních aktů. V této kapitole jsem se pokusil rozebrat nelegální pojem „nebezpečný pachatel“ a upozorňuji na jeho nežádoucí neurčitost. V následující kapitole jsem se pokusil vymezit postavení obecní policie a podmínky použití služební zbraně strážníkem dle ustanovení Zákona č. 553/1991 Sb., o obecní policii a porovnat jeho oprávnění s příslušníky Policie České republiky. V další kapitole se věnuji Vojenské policii, jejímu postavení a opět podmínkám použití zbraně vojenským policistou dle ustanovení Zákona č. 124/1992 Sb., o Vojenské policii v komparaci s příslušníkem Policie České republiky. Posledním subjektem, který se stal předmětem mého zájmu je Policie Slovenské republiky, kde jsem se opět pokusil porovnat oprávnění a podmínky při použití zbraně příslušníkem Policajného zboru dle ustanovení Zákona č. 171/1993 Z.z., o Policajnom zboru s příslušníkem Policie České republiky. Na závěr své bakalářské práce upozorňuji zákonodárce na již zmiňovaný nelegální pojem nebezpečného pachatele, kde doporučuji přiměřeně zúžit tento pojem a dále na nežádoucí odlišnost institutu nutné obrany v trestním a přestupkovém právu, který snižuje právní jistotu osob bránících se v mezích tohoto institutu s návrhem na sjednocení.

Abstract:

As a topic of my bachelor´s work I have chosen The legal aspects of using of a weapon by the Czech Republic´s Policeman. The beginning of my work I attend to definition of the term weapon and its place in the Czech Republic´s law. The next chapter of my work looks down on the Czech Republic´s Constitution and the Declaration of Basic Rights and Liberties, because these two statutes contain the general information about using a weapon. Another statute that I need to study is the new Criminal Code valid in the Czech Republic (a statute number 40/2009). Particularly the Circumstances Excluding Illegality which means an Exigence, a Private Defence and an Authorized Use of a Weapon. In the case of the Private Defence highlighting a serious problem – a different version of its definition in an Administration law and a Criminal law. In the next part of my work I am concerned with the official security forces of our country – Police of the Czech Republic. I am especially interested in its position and also in a use of a weapon by a policeman. Threfor I focus on the statute number 273/2008 about Police of the Czech Republic which contains all necessary conditions of a use of a weapon. In this chapter I also tried to analyse a term „dangerous offender“ and advert to its actual uselessness. In a following chapter I have tried to find a definition of a position of a local (city) police and conditions of a use of a weapon by its officers. All this comes out of the statute number 553/1991 about Local Police Forces. I have also compared those information with sufficient facts about Police of the Czech Republic. In the next chapter I write about the Military Police (MP). Mostly I care about the same things – a position of MP and conditions of a use of a weapon by its members. Everything comes out from the statute number 124/1992 about Military Police. The last subject that I deal with in my work is Slovakian police. Of course I compare a position of czech and slovakian police and conditions of a use of a weapon by a czech and a slovak policemen. The necessary information are written in the statute number 171/1993 about Police Forces (Slovakian). At the end of my bachelor´s work I once again decided to advise of uselessness of the term „dangerous offender“ which is actually illegal, and I suggest to specify this term a little bit more preciously. I also want to point one more time at a different version of a definition of the Private Defence in an Administration law and a Criminal law because it seriously declines a legal guarantee for those who would protect themselves in the name of the Private Defence - and at the very end I come up with a proposal of a unification.
