Victim of the rape crime

Abstract:

Bakalářská práce popisuje pojem znásilnění v širším pojetí než uvádí zákon č. 40/2009 Sb., trestní zákoník, včetně popisu oběti výše uvedeného protiprávního jednání. V této práci zároveň popíšu problematiku znásilnění komplexněji. Teoretická část bude věnována, jak je uvedeno v první větě, pojmu znásilnění v širším pojetí, a tím se otevírají různé další pojmy jako je oběť, pachatel znásilnění, viktimizace, okolnosti znásilnění,(ne)ohlášení znásilnění, a v neposlední řadě pomoc obětem znásilnění. V druhé části této práce, tedy část praktická, je věnována pozornost výzkumu, proč je tento trestný čin v takové míře latentní, co a jak ovlivňuje právě tuto latentnost. Cílem této práce, je, pokud možno nalézt odpovědi na otázku proč je tak velká míra latence kriminality u znásilnění.

Abstract:

The bachelor´s thesis describes the concept of rape in a broader sense than specified by the Act No. 40/2009 Coll., Criminal Code, including description of the victim of the aforementioned unlawful conduct. This thesis shall also provide a more comprehensive description of the issue of rape. The theoretical part shall be devoted, as stated in the first sentence, to the concept of rape in a broader context, thereby introducing various other concepts such as the victim, the perpetrator of rape, victimization, circumstances of rape, (non-)reporting of rape, and last but not least, assistance to rape victims. The second part of this thesis, the practical part, pays attention to the research on why this criminal offense is highly latent, what factors contribute to this latency, and how these specifically affect the latency. The objective of this thesis is to seek, if possible, answers to the question of why there is such a significant level of criminality latency in cases of rape.
