Abstract:

Tato diplomová práce je zaměřena na omezení osobní svobody v trestním řízení. Cílem práce je zjištění, zda právní předpisy dostatečně upravují odpovědnost za nezákonné omezení osobní svobody. V závěrečné práci jsou popsány všechny způsoby, kterými je možné omezit osobní svobodu podle aktuálně platné legislativy. Část práce je věnována vazbě a institutům, kterými lze vazbu nahradit. v závěru práce jsou popsána všechna předběžná opatření a odpovědnost za porušení právních předpisů při omezení osobní svobody.

Abstract:

This diploma thesis is focused on the restriction of personal freedom in criminal proceedings. The aim of the thesis is to find out whether the legislation sufficiently regulates liability for unlawful restriction of personal freedom. The final thesis describes all the ways in which it is possible to restrict personal freedom according to the currently valid legislation. Part of the thesis is devoted to binding and institutes that can replace the binding. at the end of the thesis, all interim measures and liability for violation of legal regulations in the restriction of personal freedom are described.
