Status and Regulation of Illegitimate Children in Historical Perspective

Abstract:

Status and regulation of illegitimate children is a topic that was, in historical perspective, connected mainly with the condemnation, discrimination and even separation of illegitimate children in the society. Illegitimate origin meant for both, mother and child, the life full of condemnation and restrictions, whether in the public life, or in the private spheres. This thesis deals with the legal status of illegitimate children in historical perspective since the roman law era, focusing on the period of the first Czechoslovak republic. It analysis the legal status of illegitimate children in the light of the legal regulation of particular legal institutes and separated chapter deals with the social security provided to illegitimate children by state.

Abstract:

Postavenie a právna úprava nemanželských detí je téma, ktorá sa v období histórie spájala s odsúdením, diskrimináciou, až ostrakizáciou nemanželských detí v rámci spoločnosti. Nemanželský pôvod znamenal pre matku aj dieťa život plný odsúdenia a obmedzení, či už vo verejnom živote, alebo v živote súkromnom. Táto práca sa zaoberá právnym postavením nemanželských detí z historického pohľadu od dôb rímskeho práva, s hlavným dôrazom na obdobie prvej Československej republiky. Rozoberá právne postavenie nemanželských detí vo svetle právnej úpravy jednotlivých právnych inštitútov a v samostatnej kapitole pojednáva o sociálnej starostlivosti štátu poskytovanej nemanželským deťom.
