Abstract:

Ochranná opatení de lege lata a de lege ferenda V úvodu této práce je definován pojem trest a z nj vycházející vymezení ochranného opatení. Obojí vychází z uritých historických teorií, které se v prbhu posledních století mnily. V následující kapitole je vymezen pojem ochranného opatení a jeho úel. Ochranné opatení stejn jako trest pedstavuje právní následek trestného inu a sleduje úel trestního zákona, kterým je chránit zájmy spolenosti, ústavní zízení eské republiky, práva a oprávnné zájmy fyzických a právnických osob. Jedním z prostedk k dosažení tohoto úelu je i ukládání a výkon ochranných opatení. Další kapitola se zabývá druhy ochranných opatení. Poátkem 90. let existovaly de lege lata tyi druhy ochranných opatení ochranný dohled, který již byl jako ochranné opatení ze zákona vypuštn, ochranné léení, ochranná výchova a zabrání vci. V souasnosti jsou na základ trestního zákona ukládány ochranná opatení ve form ochranného léení a zabrání vci. Ochrannou výchovu lze uložit pouze mladistvým a to na základ zákona o soudnictví ve vcech mládeže. V následující kapitole jsou uvedeny nkteré zásady ukládání ochranných opatení. Jedná se o zásadu jednoty trestní prevence a represe, zásadu zákonnosti trest, zásada analogie k tíži, zásada personality, zásada úelnosti, zásada pimenosti trestu a další. Ve IV. kapitole jsou zpracovány pedpoklady pro ukládání ochranných opatení tak, jak vycházejí z trestního zákona, v dlení na ochranné léení a zabrání vci. Následná kapitola nás seznamuje s ochranným opatením ve form ochranné výchovy a vychází z právní úpravy zákona o soudnictví ve vcech mládeže. Je zde i zpracováno téma výkonu ústavní výchovy nebo ochranné výchovy ve školských zaízeních ve smyslu platné právní úpravy. Následuje struný nástin možností zániku práva na výkon ochranných opatení, k jehož dvodm mže patit jejich výkon nebo upuštní od jejich výkonu i smrt odsouzeného nebo pachatele inu jinak trestného. Další kapitola o výkonu ochranných opatení nás seznámí s procesními úkony, které smují k výkonu trest a ochranných opatení. V závru práce je zmínno téma ochranná opatení de lege ferenda, kdy v souasné dob Parlament eské republiky projednává návrh nového trestního zákona, v nmž dochází k uritým zmnám u ochranných opatení. K tm nejzávažnjším patí zavedení institutu zabezpeovací detence.

Abstract:

Protective measures de lege lata and de lege ferenda (summary of the thesis) The introductory part of the thesis defines the institute of punishment and from this conception derives the institute of protective measure. Both of those are based on historical theories developping during last centuries. In the next chapter the institute and purpose of protective measure are defined. Protective measure as much as punishment represents the consequence in law of the crime and follows the purpose of the Criminal Code, which is to protect the interests of the society, constitutional system of the Czech Republic, rights and justified interests of natural persons and legal entities. Imposing and enforcement of protective measures belong to the means ensuring the supra described purpose of the Criminal Code. Subsequent chapter presents different kinds of protective measures. In the beginning of the 90. four kinds of protective measures had been available de lege lata protective surveillance (has been dismissed from the Criminal Code already), protective treatment, protective education and seizing of thing. At the present time there are two kinds of protective measures being imposed on the basis of the Criminal Code: protective treatment and seizing of thing. Protective education is imposed to the juvenile delinquents on the basis of the Act on the Youthful-Delinquency Justice. In the subsequent chapter there are described some fundamental principles of imposing protective measures: principle of the unity of the criminal prevention and repression, principle of legality, analogy in peius, principle of personality, rule of purpose-following punishment, principle of appropriateness etc. In the IV. chapter the conditions of imposing means of protection are described, as they are defined by the Criminal Code, divided into protective treatment and seizing of thing. Next chapter is devoted to the protective measure in the form of protective education based on the Act on the Youthful-Delinquency Justice. There is also described the enforcement of restrain-education or protective education in school-institutions on the basis of the regulations in force. Short summary of possibilities of the extinction of a right on the enforcement of protective measures followes, which could be caused by the completion of the enforcement, abandonment of the enforcement or death of the offender. In the next chapter the procedural acts are described, that are used when enforcing punishments and measures of protection. At the end of the thesis the point of protective measures de lege ferenda is mentioned. The Parliament of the Czech Republic is reading at the present time the bill of a new criminal code, where some changes in the field of protective measures are proposed the institute of detention belongs to the most important changes in the penal law de lege ferenda.
