Abstract:

Annotation In our essay we have tried to theoretically approaching the issue of codes of ethics in financial institutions, banking entities operating in our market in one of the chapters work marginally - for comparison and approach - we even to non-banking entities and the application of ethical codes in them. We try to explain the nature, content, importance and status of codes of ethics in the banking sector. The essay is divided into seven main chapters. The first chapter is divided into two section, consisting of several parts. In the first sub-explain the concept of ethics itself, its origins and historical origin, the subject investigation, the nature and importance of ethics as a science discipline. The second subchapter shall be paid to the very term "code of ethics, its application in financial institutions and the implementation in practice. The second chapter consists of two sub-chapters, devoted to ethical principles, the first sub-highlights social responsibility as an important principle in the ethics of this sector. The second part of this chapter is close to fundamental ethical principles specific banks operating in our financial markets. In the third chapter, broken down into two main sub-heading, the Ethics Code are discussed in the banking entities in the field of consumer protection, which is an integral part of the Code of Ethics issued by the Slovak Banking Association. In the second part of this chapter approaching the issue of codes of ethics in the non-bank entities, which form part of the financial market. The fourth chapter deals with the issue of the use of professional information in the first part - sub - data protection and banking secrecy, the second sub us close the fundamental elements of the agreement on cooperation between the banking supervisory authorities, to share information and to protect them. The fifth chapter divided into six sub-chapters we explain another equally important part of the Code of Ethics - the area of relationships with clients and business partners, banks. It emphasizes the characteristics of the bank employee as professionalism, integrity and transparency which a bank employee must be absent, the necessity of compliance with labor regulations. In one of the subchapters are discussed in the present studied hard topic such as the fight against money laundering. Approaching the topic to avoid conflict of interests, fairness in relation to the Bank, and subject exclusivity working in the banking sector. The sixth chapter is divided into three subchapters. In this part of the work we try to approximate the importance of the banking ombudsman's role in the banking sector, its close links with the banking ethics functions. The third subchapter is devoted to little else extensive topic - inšitúcii Slovak Banking Association. At last - the seventh chapter emphasize the importance of ethical rules for the financial sector, the necessity and purpose. Our work, however, notes that the Code of Ethics is not a substitute for sound judgments, or substitute employee rules and other applicable regulations and principles, stresses the fundamental idea that the Code of Ethics is a guide about how to manage the banking sector had a stick.

Anotácia práce V našej práci sme sa pokúsili teoreticky priblížiť problematiku etických kódexov vo finančných inštitúciách, bankových subjektoch pôsobiacich na našom trhu, v jednej z kapitol práce sa okrajovo – pre porovnanie a priblíženie – venujeme aj nebankovým subjektom a uplatňovaniu etických kódexov v nich. Snažíme sa vysvetliť podstatu, obsah, význam a postavenie etických kódexov v bankovom sektore. Práca je rozdelená na sedem hlavných kapitol. Prvá kapitola je rozčlenená na dve podkapitoly, skladajúce sa z viacerých častí. V prvej podkapitole vysvetľujeme samotný pojem etika, jej pôvod a historický vznik, predmet skúmania, podstatu a význam etiky ako vednej disciplíny. Druhá podkapitola sa venuje už samotnému termínu „etický kódex“, jeho aplikácii vo finančných inštitúciách a zavádzaniu do praxe. Druhá kapitola pozostáva z dvoch podkapitol, venuje sa etickým princípom, v prvej podkapitole vyzdvihujeme sociálnu zodpovednosti ako dôležitý princíp v rámci etiky tohto sektoru. Druhá časť tejto kapitoly približuje základné etické princípy konkrétnych bánk pôsobiacich na našom finančnom trhu. V tretej kapitole, rozčlenenej na dve hlavné podkapitoly, sa venujeme etickému kódexu v bankových subjektoch v oblasti ochrany spotrebiteľa, ktorý je neoddeliteľnou súčasťou etického kódexu vydaného Slovenskou bankovou asociáciou. V druhej časti tejto kapitoly približujeme problematiku etických kódexov v nebankových subjektov, ktoré tvoria súčasť finančného trhu. Štvrtá kapitola pojednáva o problematike použitia profesionálnych informácií, v prvej časti – podkapitole – o ochrane údajov a bankového tajomstva, druhá podkapitola nám približuje základné prvky dohody o spolupráci medzi orgánmi bankového dohľadu, vzájomné odovzdávanie informácií a ich ochranu. Piata kapitola rozčlenená na šesť podkapitol nám vysvetľuje ďalšiu nemenej dôležitú súčasť etického kódexu – oblasť vzťahov s klientmi a obchodnými partnermi banky. Zdôrazňuje vlastnosti zamestnanca banky ako sú profesionalita, bezúhonnosť a transparentnosť, ktoré pracovníkovi banky nesmú chýbať, nutnosť súladu jeho práce s predpismi. V jednej z podkapitol sa venujeme v súčasnosti ostro sledovanej téme akou je boj proti praniu špinavých peňazí. Približujeme tému zamedzenia konfliktu záujmov , korektnosť vo vzťahu k banke a tematiku pracovnej exkluzivity v bankovníctve. Šiesta kapitola je rozdelená do troch podkapitol. V tejto časti práce sa snažíme priblížiť dôležitosť bankového ombudsmana, jeho úlohu v bankovom sektore, úzku spätosť jeho funkcie s bankovou etikou. Tretia podkapitola sa okrajovo venuje ináč rozsiahlej téme – inšitúcii Slovenskej bankovej asociácie. V poslednej – siedmej kapitole zdôrazňujeme význam etických pravidiel pre finančný sektor, ich nevyhnutnosť a účel. Naša práca však upozorňuje na to, že etický kódex nie je náhradou za správny úsudok, ani náhradou zamestnaneckých pravidiel a iných platných princípov či nariadení, zdôrazňuje základnú myšlienku, že etický kódex je návod, akým by sa bankový sektor mal riadiť a pridržiavať.
