Public defender of rights

Abstract:

Hlavním cílem této bakalářské práce je analýza veřejného ochránce práv jako nástroje kontroly veřejné správy se zaměřením na dobrou správu a dílčím cílem je komparace právních úprav tohoto institutu v České republice a Slovenské republice s vymezením jejich shodných a odlišných znaků. První kapitola práce je věnována vzniku a vývoji ombudsmanských institucí ve světě. Druhá kapitola je zaměřena na vznik veřejného ochránce práv v České republice a jeho právní úpravu. Třetí kapitola pojednává o veřejném ochránci práv jako nástroji kontroly veřejné správy a zaměřuje se na jednu z jeho činností - kontrolu dodržování principů dobré správy. Na konkrétních případech ukazuje, jak jsou tyto principy aplikovány v praxi. Čtvrtá kapitola se věnuje vzniku veřejného ochránce práv na Slovensku a jeho právní úpravě. V poslední kapitole je provedena komparace právních úprav veřejných ochránců práv v obou státech.

Abstract:

The main objective of this Bachelor thesis is the analysis of the public defender of rights as a tool to control the public administration aimed at good governance. The partial objective is the comparison of the legislation of this institution in the Czech Republic and the Slovak Republic with delimitation of their identical and different elements. The first chapter of the thesis is devoted to the origin and development of the ombudsman institution all over the world. The second chapter focuses on the origin of the public defender of rights in the Czech Republic and the related legislation. The third chapter discusses the public defender of rights as a tool of control of the public administration aimed at one of the activities which is the monitoring of compliance of the good government principles. It demonstrates the application of these principles in practice on specific examples. The fourth chapter is devoted to the origin of the public defender of rights in the Slovak Republic and the related legislation. In the last chapter the legislation of the public defender of rights in both of the states is being compared.
