The development of contractual relations between the EU and Ukraine, with a focus on the Association Agreement preparation and the implementation of conditionality

Abstract:

Bakalářská práce se zabývá vývojem smluvních vztahů mezi Evropskou unií a Ukrajinou, přičemž jejím primárním zaměřením se stala problematika přípravy asociační dohody. Práce je založena na konceptu sousedské evropeizace v souvislosti se specifickým fungováním principu kondicionality a jeho limity. Hlavním cílem práce je analýza uplatňování principu kondicionality ve vztazích EU-Ukrajina před vznikem Východního partnerství a posléze v jeho kontextu v souvislosti s nově příchozím nástrojem, který představovala asociační dohoda. Práce je zaměřena na období 2007-2013, tedy od počátku vyjednávání o asociační dohodě až po summit ve Vilniusu 2013. Práce zodpovídá následující výzkumné otázky: Jak funguje princip kondicionality v kontextu sousedské evropeizace? Jaké jsou limity jeho uplatňování? Jak se princip kondicionality projevoval ve smluvních vztazích EU a Ukrajiny se započetím jednání o asociační dohodě a po vzniku VP?

Abstract:

The thesis deals with the development of contractual relations of Ukraine and the European Union, focusing on the issue of preparation of the Association Agreement. The thesis is based on the concept of Neighbourhood Europeanization in the context of specific functioning of the principle of conditionality and its limits. The main aim of this thesis is to analyse the application of the principle of conditionality in the EU-Ukraine relations before the estabilishment of the Eastern Partnership and consequently in the context of the Eastern Partnership in connection with its new institutional tool which represents the Association Agreement. The thesis concerns on the period 2007-2013, thus from the beginning of negotiations on the Association Agreement up to the summit in Vilnius which was held in 2013. The thesis answers the following questions: How does the principle of conditionality work in the context of Neighborhood Europeanization? What are the limits of its application? How is the principle of conditionality showed in the contractual relations between the EU and Ukraine with the start of negotiations on the Association Agreement and after the estabilishment of the Eastern Partnership?
