The State of Emergency within Deliberative Democratic Systems: Democratizing Prospects of the Systemic Approach and Governance Networks

Abstract:

Přestože je deliberativní demokracie živým předmětem akademického výzkumu, téma nouzových stavů, které jsou s deliberativní demokracií často v zásadním konfliktu, je stále poměrně neprozkoumané. Zatímco deliberativní demokracie se vyznačuje inkluzivním, smysluplným a nepřetržitým vstupem různých perspektiv, stav nouze obvykle existuje výslovně proto, aby tyto prvky obcházel a soustředil moc na exekutivní orgány ve státě. Tato práce zkoumá užitečnost nouzového stavu jako mechanismu v moderních státech a dopady na demokratickou kvalitu při jeho uplatnění. Práce poté zkoumá Mansbridgeův systémový přístup k deliberativní demokracii a zvažuje, zda výjimečný stav v takovém systému může přispět ke zlepšení kvality demokracie a deliberativního rozhodování, přestože byl navržen s opačným cílem. Rozšiřujíc svůj záběr, práce dále rozebírá dva z Drzekových příspěvků, které se snaží posunout hranice akademického porozumění teorie deliberativní demokracie prostřednictvím konceptů sítí spojených s řízením (governance networks) a meta-konsensu (meta-consensus). Bez snahy rozšiřovat tyto teorie do jejich plné implementace, práce využívá tyto koncepty k tomu, aby představila prostředky, které by mohly vést ke zvýšení demokratické kvality za mimořádných nouzových podmínek.

Abstract:

As the scholarship on deliberative democracy expands and enriches, the topic of states of emergency has remained yet absent despite the contrast in its functional logic. Whereas deliberative democracy features the inclusive, meaningful, continuous input of varying perspectives, the state of emergency typically exists expressly to bypass these elements and concentrate power with the executive. This thesis examines the utility of the state of emergency as a mechanism in modern states and its impacts on democratic quality when employed. It then explores Mansbridge’s systemic approach to deliberative democracy and considers whether the state of emergency within such a system may contribute to a net positive effect on deliberative or democratic quality in spite of its design to the contrary. Broadening in scope, the thesis then discusses two of Dryzek’s contributions on the frontiers of deliberative democratic theory through governance networks and the meta-consensus. Without forecasting these theories to their full implementation, the thesis uses the concepts to offer insights for increasing democratic quality under emergency conditions.
