"Insolvency Proceedings in Practice Not Only in Legal Terms" Through the Prism of Amendments

Abstract:

Složitý proces insolvenčního řízení je předmětem mnoha odborných publikací. Poté, co došlo k poslední novelizaci zákona č. 182/2006 Sb., Zákona o úpadku a způsobech jeho řešení (insolvenčního zákona), staly se tyto změny předmětem zájmu odborné i laické veřejnosti; ovlivnily i volbu tématu této závěrečné práce. Tato práce se skládá ze dvou částí – první se věnuje samotné přípravě dlužníka ke vstupu do insolvenčního řízení a poukazuje na těžkosti, které s sebou novela insolvenčního zákona přinesla. Mimo jiné i kvůli nově vtěleným právním ustanovením. Dvěma z nich se práce věnuje podrobně – a sice § 390a a § 418a-l. Oba totiž mají jedno společné – taxativně určují okruh osob, jimž svěřil pravomoc k sepisu a podání insolvenčního návrhu; oběma určil výši odměny za tyto úkony a všem dotčeným stranám skrze znění těchto právních ustanovení určil za povinnost služeb vyjmenovaných kvalifikovaných a akreditovaných osob využívat. Rozboru těchto zákonů je poté věnována podrobná část práce.

Abstract:

The complex process of insolvency proceedings is the matter of many professional publications. After the last amendment to Act No. 182/2006 Coll., of the Bankruptcy Act and the ways of its solution (insolvency law), these changes have become a subject of interest to the professional and lay public; influence the choice of the topic of this thesis. This work consists of two parts – the first is devoted to the preparation of the debtor to enter into insolvency proceedings and points out the difficulties with the amendment of the Insolvency Act. Among other entactments, embodied in. Two of legal amendments are dedicated to work in detail – namely paragraph 390a and paragraph 418a-l. Both have one thing in common – exhaustively define the people´s sphere of authority to whom they have entrusted with the preparation and submission to the jurisdiction of the insolvency petition; the two determine the amount of remuneration for these acts and to all interested parties through the text of the legal provision for the obligation to determine the services listed qualified and accredited people strictly named by law. The analysis of these statutes is described in detail.
