Selected Merits of Unfair Competition and the Courts' Decision-making Practice

Abstract:

Tato práce se zabývá problematikou nekalé soutěže a příslušné rozhodovací praxe soudů. První část se věnuje pozitivně právní úpravě v zákoně č. 89/2012 Sb., s důrazem na změny, které tato rekodifikace soukromého práva přinesla. Jelikož se jedná o přeshraniční problematiku, v další části došlo i k rozboru úpravy na úrovni Evropské Unie. Meritem této práce byl popis vybraných skutkových podstat nekalé soutěže v kontextu se zdůrazněním klíčové role soudní judikatury při výkladu jednotlivých ustanovení.

Abstract:

This thesis deals with the issue of unfair competition and the decisional practice of the courts. The first part focuses on positive legislation in Act no. 89/2012 Coll., with an emphasis on the changes that this recodification of private law brought. Since this is a cross-border issue, in the subsequent part I also analysed the regulations at the level of the European Union. The merit of this thesis was to describe the selected facts of unfair competition in the context of stressing the key role of the case-law of the courts in interpreting the provisions.
