Abstract:

Tématem bakalářské práce je územní řízení, které je součástí stavebního zákona. V roce 2006 byl schválen nový stavební zákon s účinností od 1. ledna 2007, jehož záměrem bylo zpřehlednění a zjednodušení územního a stavebního řízení. Práce objasňuje jednotlivé postupy při územním rozhodování a ohlašování, jak probíhá územní rozhodování v zastavěném území a na zastavitelných plochách, ale také v nezastavěném území a plochách. Dále jsou popsány jednotlivé typy územních řízení, včetně postupu stavebních úřadů a práv a povinnosti stavebníků. S ohledem na uvedení nového stavební zákona do praxe je toto téma zaměřeno na podrobnou analýzu a vyhodnocení nové právní úpravy této části stavebního zákona, včetně jeho přínosu účastníkům řízení ve věcech stavebního práva a taktéž pro stavební úřady, které se daným stavebním zákonem řídí.

Abstract:

The subject of the baccalaureat bachelor thesis is a land management part of the building law. A new building law was passed in 2006 and formally enacted January 1, 2007. Its main purpose is a clarification and simplification of the land management and management of the building procedures. The thesis discusses specific procedures of land management and of the building registration, namely procedures applicable to built-up lots and levels as well as vacant lots and levels. Furthermore, it describes individual types of land management decision-making. Included are procedures employed by the building authorities and the rights and obligations of the builders. With the new building law in force, the main purpose of the thesis is a detailed analysis and examination of the new legal provisions relating to the above mentioned topics, of their advantages to individuals who deal with the building law and to the building agencies which have to follow the building law.
