The factual nature of the crime and its features

Abstract:

Diplomová práce se zabývá tématem skutkové podstaty trestného činu a jejími znaky. Téma této diplomové práce je pro společnost nesmírně důležité, především pro odbornou společnost, ale také pro laickou veřejnost, jelikož téma skutkové podstaty trestného činu může na laickou veřejnost působit informativně, ale stejně tak i preventivně. Cílem diplomové práce je analyzovat obsáhlou právní úpravu, která se vztahuje ke skutkové podstatě trestného činu, tuto problematiku čtenářům blíže přiblížit a porozumět jí. Při zpracování práce bude postupováno tak, že po shromáždění informací z odborných pramenů a otevřených zdrojů bude provedena deskriptivní analýza skutkové podstaty trestného činu a její znaků. První kapitola prezentuje základní pojmy, které se vztahují k tématu práce. Ve druhé kapitole je zaměřeno na skutkovou podstatu trestného činu a její význam pro trestní právo. Třetí kapitola navazuje na problematiku výkladem formálních znaků trestného činu. Čtvrtá kapitola je zaměřena na komparaci české právní úpravy skutkové podstaty trestného činu a její znaků s vybranými zahraničními úpravami. V poslední páté kapitole jsou stanoveny shody a rozdíly mezi českou a zahraniční úpravou a návrhy k dané problematice.

Abstract:

The diploma thesis deals with the topic of the essence of the crime and its signs. The topic of this thesis is extremely important for the society, especially for the professional society, but also for the general public, because the topic of the essence of a crime can have an informative and preventive effect on the general public. The objective of the thesis is to analyse the complex legal regulations related to the essence of a criminal act, to bring this issue closer to the readers and to understand it. During the processing of the thesis it will be proceeded in a way that after collecting information from expert sources and open sources, a descriptive analysis of the nature of the crime and its features will be carried out. The first chapter represents the fundamental concepts relating to the topic of this dissertation. The Second chapter focuses on the Elements of a Criminal Offence and its meaning within Criminal Law. The Third chapter explains the formal features of the crime. The Fourth chapter compares Czech legislation on the substance of a crime and its implications with selected foreign regulations. Differences between Czech and foreign regulations are outlined in the fifth chapter, which also includes additional suggestions proposals recommendations on the given issues.
