Causes of hate crimes and the consequences

Abstract:

Ve své diplomové práci se zabývám problematikou trestných činů z nenávisti, zaměřené zejména na pohnutky a důsledky. Tyto trestné činy jsou motivované nenávistí zejména ke skutečné či domnělé příslušnosti k rase, národnosti a etnicitě, náboženství, víry, sexuální orientaci, genderové příslušnosti, fyzického nebo mentálního postižení, věku, třídy politické orientaci. Jsou podpořené společensko-ekonomickou situací ve společnosti a předsudky, předpojatostí a stereotypy daného jedince nebo skupiny, jež jsou v mé práci označované jako kriminogenní faktory. V České republice je tato problematika stále uváděna v souvislosti s extremismem, proto je součástí této práce i extremismus a jeho příbuzná ideologie. Neopomíjím jevy jako rasismus a xenofobie. Práce obsahuje legislativu České republiky doplněnou i mezinárodními smlouvami. Pro porovnání uvádím legislativu Spojených států. V USA vznikl koncept hate crime, který se rozšiřoval postupně do všech zemí a stal se světovým termínem. Právě trestné činy z nenávisti by měly být jeho překladem. Avšak okruh problematiky je velice rozsáhlý a doprovází ho mnoho nedostatků. Dále se zabývám typickými pachateli a jejich specifickými znaky i typickou obětí. Mezi nejohroženější skupiny zařazuji Romy, cizince, bezdomovce, LGBT členy, zdravotně postižené a další jedince označené pod pojmem marginalizované skupiny. V části o oběti řeším její viktimizaci. Viktimizaci obětí trestných činů z nenávisti provází určité body, kterými se liší od viktimizace u běžné kriminality.Teoretickou část zakončuji kapitolou o prevenci trestných činů z nenávisti. Je zaměřená na metody a programy vypracované ze sebraných dat, které poskytlo Ministerstvo vnitra České republiky. V práci využívám popisnou metodu k vymezení problematiky a deskripci charakteristických znaků. Teoretickou část práce doplňuji praktickou částí. Uvádím zde případy z kazuistiky, doplněny mým komentářem a rozhovory s dotazovanými, jenž se tato problematika týká.

Abstract:

In my diploma thesis I occupy with the issue of the hate crimes focused mainly on motives and consequences. These crimes are mainly motivated by actual or deemed membership of race, nationality and ethnicity, religion, belief, sexual orientation, gender, physical or mental disability, age, class, political orientation. They are supported by the socio-economic situation in society and the prejudices, biases and stereotypes of the individual or group, which are referred to as criminogenic factors in my thesis. In the Czech Republic this issue is still mentioned in connection with extremism, and therefore extremism and its related ideology are also part of this thesis. I do not miss out the phenomena such as racism and xenophobia.The thesis contains legislation of the Czech Republic, supplemented by international treaties. For comparison, I mention US legislation. In the US, the concept of hate crime, which gradually spread to all countries and became a world term. However, the scope of the issue is very extensive and is accompanied by many shortcomings. Furthermore, I deal with typical perpetrators and their specific features and their typical victims. The most vulnerable groups include Romani people, foreigners, homeless people, LGBT members, the disabled and other individuals identified as marginalized groups. In the chapter on victim I deal with victimization in the chapter about victim. The victimization of hate crime victims is accompanied by certain points that are different from victimization in ordinary crime. The theoretical part concludes with a chapter on the prevention of hate crimes. It focuses on methods and programmes developed from the collected data provided by the Ministry of the Interior of the Czech Republic. In this thesis I use descriptive method to define the issue and its characteristics. The theoretical part is complemented by a practical part. I present cases from case reports, supplemented by my commentary and interviews with interviewees, who are involved in this issue.
