Liability Of Law According To Breaking The Author s Law During Computers Work

Abstract:

Práce se zaměřuje na aspekty trestněprávní odpovědnosti vyplývající z některých činností při práci s výpočetní technikou, která v současné době stále více zasahuje do každodenního života nás všech. Pozornost je z tohoto hlediska věnována též fenoménu celosvětové sítě Internet. Definuje počítačovou kriminalitu a stručně vysvětluje základní pojmy, které je nutno znát pro pochopení problematiky, především hacking, cracking a warez, které úzce souvisí s činností nazývanou softwarové pirátsví. Poté se soustředí na počítačovou kriminalitu porušující autorská práva. Po nahlédnutí do historie, kdy s rozšířením osmibitových počítačů začal nabývat problém porušování autorským práv značných rozměrů hodnotí stav v této oblasti v současnosti, kdy intenzívní nástup digitálních technologií takové jednání značně usnadňuje a konstatuje, že se již jedná o masovou záležitost, které je třeba věnovat odpovídající pozornost. Na konkrétních kauzách nastiňuje rozhodovací praxi soudů a její vývoj v různých částech světa. V další části se práce věnuje rozboru právní úpravy porušování autorských práv v České republice, a to se zaměřením na nejčastější formu – při práci s počítačem, včetně stahování či sdílení dat prostřednictvím sítě Internet. Rozebírá ustanovení § 152 trestního zákona, které danou problematiku upravuje, v návaznosti na příslušná ustanovení autorského zákona číslo 121/2000 Sb., v aktuálním znění, včetně poslední novely číslo 216/2006 Sb. Rozboru jsou také podrobeny jednotlivé formy počítačového pirátství porušující autorská práva, a to jejich porušování ve vztahu k počítačovým programům, hudebním nahrávkám a filmovým dílům. Práce se v neposlední řadě věnuje též nahlédnutí do úpravy rozebírané problematiky v zahraničí, a to především ve Spojených státech. Další část je věnována potírání počítačové kriminality porušující autorská práva státními represivními složkami, tedy Policií České republiky, ale zmiňuje též aktivity největších tzv. kolektivních správců, jejichž hlavní náplní činnosti je právě prosazování zájmů autorů a ochrana jejich autorských a s nimi souvisejících práv. Prostor je však věnován také námitkám z „druhé strany“ pomyslné barikády, tedy nejčastějším námitkám nejen osob dopouštějících se porušování autorských práv prostřednictvím počítače, ale i odborné veřejnosti. V poslední části práce jsou naznačeny možnosti preventivního působení na stávající i potenciální pachatele a úvahy o výhledech v této oblasti do budoucna.

Abstract:

The work deals the aspects of penal and legal responsibility arising from some activities during computer work that nowadays as much as possible interferes with our everyday life. The attention from this point of view is also payed to phenomenon of a worldwide net – to the Internet. The work defines a computer criminality and explains briefly the basic terms which are necessary to know for understanding problems, especially hacking, cracking and warez. These terms are closely connected with the activity called software piracy. Then the work is concentrating on computer criminality breaking the Author´s Law. After looking to history when the eight-bites computers were extended there was increasing the problem of breaking the Author´s Law. The work evaluates a condition at this field nowadays when an intensive entrance of digital technologies such an action makes easy and says the following. It is a mass business that is useful to pay according attention to it. The work outlines deciding courts´ practise and its development in the different parts of world on concrete cases. The work in its other part deals analysis of legal amendment breaking the Author´s Law in the Czech Republic. It is especially intent on the most frequent form – during a computer work, inclusive of gathering together or shering dates using the net – the Internet. It takes into parts paragraph 152 of the Penal Law that these mentioned problems modifies following relevant enactments of the Author´s Law - number 121/2000 digest, in an actual treatise, inclusive of the last novelette – number 216/2006 digest. The particular forms of a computer piracy breaking the Author´s Law are discussed there, especially its breaking according to computer programmes, musical recordings and film works. The work also deals a look to amendment discussed problems abroad, especially in the United States of America. The next part of the work deals combating computer criminality breaking the Author´s Law by the state repressive units, it means by the Police of the Czech Republic. It also makes a mention of activities of the greatest, so called collective managers. Their main task is just the enforcement of the authors´ interests and the protection of their author´s laws. The space is also dedicated to the objections from „the second side“ of an imaginary barricade, so to the most frequent objections of not only persons breaking the Author´s Law using a computer, but of a professional public, too. The last part of the work deals the possibilities of a preventive influence on contemporary and potential criminals and the accounts of views in this field into the future.
