Liability for defects in commercial law

Abstract:

In commercial law there is the treatment of liability for defects which is quite extensive and complicated institute as well. To understand correctly it is necessary to carefully study the literature, which is devoted to the subject. There has already been lots of contributions done regarding the issue, however resarch is still needed to be done. Due to the dynamic development of business relations and activities, the importance of commercial law increasingly gaining momentum. When the defects occur between bussiness entities, it is neccessary to rise liability from them. I regarded this thesis as effective clarification which law will be guided in determining the liability.

Abstract:

V obchodnom práve je úprava zodpovednosti za vady pomerne obsiahly a komplikovaný inštitút. K jeho správnemu pochopeniu je potrebné dôkladne si preštudovať odbornú literatúru, ktorá sa danej problematike venuje. O tejto problematike už bolo napísaných pomerne veľa prác a aj napriek tomu je jej výskum stále potrebný. Z dôvodu dynamického rozvoja podnikateľských vzťahov a aktivít význam obchodného práva stále viac naberá na intenzite. Keď sa medzi podnikateľskými subjektmi v rámci ich podnikateľskej činnosti vyskytnú vady, je potrebné z nich vyvodiť zodpovednosť. Túto prácu považujem za prínosnú, pretože objasňuje, ktorým predpisom sa je potrebné pri určení zodpovednosti riadiť.
