The Procedure of making and realization of the district law of the year 1920

Abstract:

Období po roce 1918 bylo pro naši republiku velmi složité. Skončila válka a vznikl nový samostatný stát – Československá republika. Vznikl spojením Čech (tedy Čech, Moravy a Slezska) a Slovenska. Později byla připojena ještě Podkarpatská Rus. V každém z těchto států fungovaly různé systémy veřejné správy. Byly nedokonalé a zastaralé. Vznik samostatného státu znamenal jasné přijetí demokratických principů. Musela jim být přizpůsobena i veřejná správa. Základními požadavky a cíli reformy bylo přiblížení obyvatelstva správě, unifikace veřejné správy ve všech zemích, zapojení obyvatelstva do fungování veřejné správy a zlevnění a zrychlení správních řízení a postupů. Ministerstvo vnitra, v čele s Antonínem Švehlou, začalo připravovat reformu hned po vzniku republiky. V roce 1919 představili návrh zákona, který měl vše vyřešit. Měly být zrušeny země (dosavadní zřízení) a nahrazeny župami. Zákon byl velmi kritizován. Musel být několikrát přepracován. Nakonec byl schválen jako zákon č.126/1920 Sb. Jeho realizace byla stále odkládána. Nakonec byl realizován pouze na Slovensku. To způsobilo ještě větší roztříštěnost správního systému. Při realizaci na Slovensku se ukázala řada nedostatků. Zákon byl nahrazen organizačním zákonem v roce 1927. Tato problematika je tématem mojí bakalářské práce. Tato práce obsahuje devět kapitol. Ty jsou rozděleny na další podkapitoly. Zabývá se přípravou, přijetím a realizací zákona č.126/1920 Sb. Vedoucím práce je doc.JUDr. Karel Schelle, CSc. Je to významný specialista v této oblasti. To vyplývá i z obsahu použité literatury. Jeho publikace pro mne byly velkým přínosem.

Abstract:

The period after the year 1918 was very difficult for our country. After the First World War, the new independent state was founded – Czechoslovak republic. It was a union of Bohemia (that is Czech, Moravia and Silesia) and Slovakia. Later on, Subcarpathian Ruthenia was added as well. In each of these states there were different public administrations, which were imperfect and obsolete. After the foundation of the new state the democratic principles had been accepted and the public administration had to be regulated by them. The basic requirements and aims of the reform were to draw the population nearer to the public administration, to unify the public administration in the countries, to include the inhabitants in to its working process, and to cheapen and accelerate the administrative procedures. The Ministry of Internal Affairs, headed by Antonín Švehla, begun to work on the reform immediately after the foundation of the state. In the year 1919 was presented the draft of the act that was to solve all the matters mentioned above. The existing establishments of the particular countries were to be abrogated and replaced by districts. However, the new law was criticized a lot and had to be rewritten several times. Finally, it was passed as an act no. 126/1920 Sb. Its execution had been continually postponed and at last it was brought into effect only in Slovakia. This caused even bigger fragmentation of the administration system. During the time it was in effect in Slovakia, it proved many defects and it was, finally, replaced by an organizational act in the year 1927. These matters are the subjects of my bachelor thesis. The work contains nine chapters which are divided on subchapters and deals with the preparation, adoption and the execution of the act no. 126/1920 Sb. The supervisor of my thesis is doc. JUDr. Karel Schelle, renowned expert in this field. This can be also seen in the literature used in my thesis. His works were of a great help to me.
