Abstract:
Tato práce je věnována kauzalitě a na ní závisejícím přičítání právní odpovědnosti. Jejím cílem je analyzovat současné zkoumání kauzality v českém právu a upozornit na nedostatky používaných postupů. Za tímto účelem práce rozebírá testy faktické kauzality (test conditio sine qua non a NESS test) a normativní kritéria přičitatelnosti (zejména teorii adekvátnosti a teorii ochranného účelu normy). This thesis is dedicated to causation and the attribution of legal re-sponsibility dependent on it. Its aim is to analyse the current proce-dure for determining causation in Czech law and to point out short-comings of the procedures used.
