The legal bindingness and significance of UN Security Council resolutions in ensuring international peace and security

Abstract:

Tato bakalářská práce se zabývá právní závazností a významem rezolucí Rady bezpečnosti OSN při zajišťování mezinárodního míru a bezpečnosti. Rada bezpečnosti je jediným orgánem OSN oprávněným činit právně závazná rozhodnutí, včetně přijetí opatření podle kapitoly VII Charty OSN. Cílem práce je analyzovat právní povahu těchto rezolucí, rozlišit mezi doporučujícími a závaznými rozhodnutími, a zhodnotit jejich efektivitu v konkrétních mezinárodních konfliktech. Práce je rozdělena do čtyř kapitol. První kapitola popisuje institucionální postavení Rady bezpečnosti v systému OSN. Druhá kapitola se věnuje vývoji právní závaznosti rezolucí, přičemž analyzuje klíčová ustanovení Charty a relevantní judikaturu Mezinárodního soudního dvora. Třetí kapitola využívá případové studie (např. Kuvajt, Kosovo, Irák, Libye, Sýrie, Ukrajina) k ilustraci rozdílů v implementaci rezolucí v praxi. Čtvrtá kapitola hodnotí efektivitu Rady bezpečnosti, upozorňuje na problémy spojené s právem veta a omezeným zastoupením a zabývá se navrhovanými reformami. Na základě provedené analýzy práce dospívá k závěru, že účinnost rezolucí Rady bezpečnosti je podmíněna nejen jejich právní povahou, ale především politickou vůlí státních aktérů a strukturálními limity samotné Rady. Přesto zůstává Rada bezpečnosti jedním z klíčových nástrojů pro udržení míru ve světě a není prozatím nahrazena žádnou alternativní institucí s obdobnou legitimní autoritou.

Abstract:

This bachelor’s thesis examines the legal binding force and significance of United Nations Security Council resolutions in maintaining international peace and security. The Security Council is the only UN body authorized to adopt legally binding decisions, including measures under Chapter VII of the UN Charter. The aim of this thesis is to analyze the legal nature of these resolutions, distinguish between recommendatory and binding decisions, and evaluate their effectiveness in specific international conflicts. The thesis is structured into four chapters. The first chapter describes the institutional role of the Security Council within the UN system. The second chapter focuses on the evolution of the legal bindingness of resolutions, analyzing key provisions of the Charter and relevant jurisprudence of the International Court of Justice. The third chapter uses case studies (e.g. Kuwait, Kosovo, Iraq, Libya, Syria, Ukraine) to illustrate differences in the implementation of resolutions in practice. The fourth chapter evaluates the effectiveness of the Security Council, highlights issues related to the veto power and limited representation, and explores proposed reforms. Based on the conducted analysis, the thesis concludes that the effectiveness of Security Council resolutions depends not only on their legal nature but primarily on the political will of state actors and the structural limitations of the Council itself. Nevertheless, the Security Council remains one of the key instruments for maintaining peace in the world and has not yet been replaced by any alternative institution with comparable legitimate authority.
