Anamnesis: Remembrance of the material source of international law in the works of Rafael Domingo and Antônio Augusto Cançado Trindade

Abstract:

Tématem rigorózní práce je zhodnocení návrhů na rekonstrukci mezinárodního práva veřejného, resp. konstrukci nového globální právního řádu, autorů Antônio Augusto Cançado Trindade a Rafaela Domingo. Toto hodnocení je provedeno výlučně z teoretické perspektivy politické a právní filozofie jako hledání materiálního pramene práva v přítomnosti na základě rozpomínky (anamnesis) na jeho význam v minulosti. Práce za tímto účelem shrnuje genealogii konceptu ius gentium u těchto dvou autorů a rozšiřuje diskuzi nad teorií práva a státu u významných autorů evropské politické filozofie. Nadto pozornost je věnována teoretickým zdrojům materiálního pramene práva v tradicích neoliberalismu a neomarxismu, které oba sledovaní autoři opomíjí. Závěrem práce je popsání teorie materiálního pramene práva v jejich dílech, což je umožňuje vymezit a zhodnotit jako alternativu k převažujícím koncepcím mezinárodního práva v současnosti.

Abstract:

The subject matter of this thesis is an evaluation of two recent contributions by Rafael Domingo and Antônio Augusto Cançado Trindade to a new global legal order, or reconstruction of public international law, respectively. This evaluation is made from the theoretical standpoint of political and legal philosophy as a search for a material source of law in the present, which is grounded in a remembrance (anamnesis) of its meaning in the past. The thesis therefore encapsulates a genealogy of the concept ʻius gentiumʼ according to these two authors and extends their account concerning the foundations of the law and the state according to some prominent figures in European political philosophy. Further attention is given to the theoretical underpinning of the material sources of law of some neoliberal and neomarxist thinkers, which are completely omitted by both Domingo and Trindade. In the end, their theories concerning the material sources of law are described and evaluated as an alternative to contemporary conceptions of international law.
