Protection of whistleblowers in Czech Republic and EU legislation

Anotácia:

Bakalářská práce se zaměřuje na problematiku ochrany whistleblowerů a snaží se poukázat na jejich právní úpravu jak na národní, tak evropské úrovni. Česká republika dle poznatků získaných touto prací za Evropskou unií výrazně zaostává, neboť teprve od srpna 2023 implementovala evropskou Směrnici o ochraně osob, které se rozhodly oznámit protiprávní jednání. Tato bakalářská práce se uvedenému tématu věnovala jak po teoretické stránce, tak i po praktické. Představila některé kauzy světových i českých whistleblowerů. Taktéž bylo uskutečněno dotazníkové a expertní šetření, která prokázala, že ochrana oznamovatelů je v České republice na velmi nízké úrovni a je tedy zapotřebí přijmout adekvátní zákon. Tím pádem by se i více lidí odvážilo oznámit spáchání trestného činu související např. s korupcí či jinými protiprávními činy, neboť by byli více chráněni, a nebyli postihováni jak zaměstnavatelem, tak i celou společností.

Abstract:

The bachelor's thesis focuses on the issue of the protection of whistleblowers and tries to point out their legal regulation both at the national and European level. According to the findings obtained in this thesis, the Czech Republic lags significantly behind the European Union, as it has only since August 2023 implemented the European Directive on the protection of persons who have decided to report illegal acts. This bachelor's thesis was devoted to the mentioned topic both from a theoretical and a practical point of view. She presented some cases of global and Czech whistleblowers. A questionnaire and expert survey were also carried out, which proved that the protection of whistleblowers is at a very low level in the Czech Republic, and therefore it is necessary to adopt an adequate law. As a result, more people would dare to report the commission of a crime related to, for example, corruption or other illegal acts, because they would be more protected, and would not be penalized both by the employer and by society as a whole.
