Abstract:

Diplomová práce pojednává o jurisdikci na internetu se zaměřením na přeshraniční pomluvu. Práce je členěna do osmi kapitol. První kapitola vymezuje základní pojmy pojící se s tématem – pravomoc, mimosmluvní závazky, pomluvu, internet a kyberprostor. Druhá kapitola odpovídá na otázku, zda je nutné regulovat prostředí kyberprostoru. Třetí, čtvrtá a pátá kapitola jsou stěžejní pasáží diplomové práce. Kapitola třetí se zabývá doktrínou forum non conveniens, na základě níž soudy států common law odmítají svou jurisdikci. Kritéria, k nimž soud přihlíží při rozhodování o své pravomoci, jsou vyjmenována v kapitole čtvrté. Kapitola pátá se zaměřuje výhradně na Spojené státy americké a jejich odlišný přístup označovaný jako minimální kontakt. V šesté kapitole je analyzováno aktuální soudní rozhodnutí Soudního dvora Evropské unie týkající se narušení soukromí skrze internet. Sedmá kapitola se zaobírá nepříznivými důsledky, které plynou z rozdílných právních úprav pomluvy. V rámci kapitoly osmé jsou nastíněny největší nedostatky stávající právní úpravy pomluvy a předestřena možná řešení nápravy.

Abstract:

Diploma thesis deals with the jurisdiction on the internet focusing on cross-border defamation. Paper is devided into eight chapters. The first chapter describes basic terms which are connected with the topic – jurisdiction, non-contractual obligations, defamation, internet and cyberspace. The second chapter answers the question if it is neccesary to regulate cyberspace. The crucial part of diploma thesis is incorporated into the third, fourth and fifth chapter. Chapter third is concerned with refusing the jurisdiction in accordance with the doctrine forum non conveniens. The list of criterion which court takes into consideration in deciding of his jurisdiction is enumerated in chapter four. The fifth chapter is directed at the United States of America especially and their different approach which is called minumum contact. Current judgment of the Court of Justice of European Union, concerning violation of privacy through the internet, is analyzed in the sixth chapter. The seventh chapter occupies with negative consequences which arise from different legislation regarding defamation. Within the eighth chapter the biggest deficiencies of present legislation are outlined and possible solutions are suggested.
