Disertace se věnuje možnostem jednotlivce za situace, kdy je nenáležitě implementována směrnice EU. Text vyzdvihuje, jakým okolnostem národního případu by měl jednotlivec věnovat pozornost, jestliže si přeje zjistit, zda v rámci svého sporu může aplikovat přímý/nepřímý účinek unijní směrnice, nebo odpovědnost typu Francovich. The Thesis explores options an individual has in a situation, when a directive of the EU has been incorrectly implemented. The text highlights aspects of the national case to which the private subject should pay attention to in order to ascertain whether he can apply direct/indirect effect of the EU directive or the Francovich liability in his particular dispute.
