Trade unions, the right to strike

Abstract:

Cílem této diplomové práce je zpracovat problematiku týkající se pojmů odborové organizace a práva na stávku, se kterými se lze zvláště v poslední době často setkat. Nejprve se práce zabývá historií kolektivního pracovního práva a uvádí jeho prameny. Dále vymezuje základní pojmy. Stěžejní části práce jsou věnovány právě odborovým organizacím a v návaznosti právu na stávku a to zejména z pohledu kolektivního pracovního práva. Zde se práce snaží nejen popsat současnou situaci, ale zároveň i upozornit na její úskalí. V části zabývající se právem na stávku je poté rozebrán i věcný záměr zákona o stávce a výluce. V poslední části je zahrnut dotazník, v němž respondenti odpovídali na otázky týkající se odborových organizací a práva na stávku. Smyslem provedeného dotazování bylo zjistit vnímání role odborů ve společnosti a názor veřejnosti na některá z ustanovení týkající se věcného záměru zákona o stávce a výluce.

Abstract:

The aim of this diploma thesis is to elaborate problems relating to the definition of trade unions and the right to strike, which we can especially in recent times often encounter. Firstly, it deals with the history of collective labour law and describes the legislation. Furthermore, the diploma thesis defines basic notions in this area. The main part is devoted to just trade unions, and consequently the right to strike, especially from the perspective of collective labour law. Here, the work seeks not only to describe the current situation, but also to highlight its pitfalls. In the section dealing with the right to strike is then disassembled the legislative intention of the strike and lockout. The last part is a questionnaire in which respondents answered questions about the trade unions and the right to strike. The purpose of the inquiries made to find out the perception of the role of trade unions in society and public opinion on some of the provisions relating to the substance of the law on strike and lockout.
