Influence of Investigative Commission Chamber of Deputies to Criminal Proceedings

Abstract:

Tato práce analyzuje činnost vyšetřovacích komisí Poslanecké sněmovny Parlamentu ČR ve vztahu k trestnímu řízení. V první části jsou zpracovány základní teoretické pojmy a přístupy týkající se trestního řízení, subjektů trestního řízení, vyšetřovacích komisí, veřejného zájmu a kontrolních mechanismů. V praktické části se budu zabývat komparativní analýzou tří vybraných vyšetřovacích komisí. Zaměřím se zde na důvody a okolnosti vzniku jednotlivých komisí, průběhy vyšetřování, závěry a jejich stanoviska. Cílem této práce je zjistit, zda má vyšetřování dočasných poslaneckých komisí potenciál nepřímo ovlivnit trestní řízení, popřípadě kdy a jakými způsoby k tomuto může docházet.

Abstract:

This work analyses the activity of the investigative commissions of the Chamber of Deputies of the Parliament of the Czech Republic in relation to the criminal proceedings. In the first part the basic theoretical concepts and approaches concerning criminal proceedings, subject of criminal proceedings, investigative commissions, public interest and control mechanisms are elaborated. In the practical part I would deal with a comparative analysis of three selected investigative commissions. I will focus on the reasons and circumstances of each commission, the process of the investigation, the conclusions and their opinions. The aim of this work is to find out whether the investigation of temporary parliamentary committees has the potential to indirectly influence the criminal proceedings, or when and how they may occur.
