Detection and clearing of crime committed against young people

Abstract:

Tématem bakalářské práce je odhalování a objasňování trestné činnosti páchané na mládeži. Bakalářská práce se dále zabývá nejzávažnějšími a nejčastěji páchanými trestnými činy na dětech a je rozdělena na teoretickou a praktickou část. Teoretická část je členěna na 5 kapitol. První kapitola se zaměřuje na vymezení a popis základních pojmů, které jsou významné zejména z hlediska trestního práva a které jsou stěžejní pro samotné téma práce. Druhá kapitola pojednává o stavu a struktuře kriminality páchané na mládeži. Třetí kapitola teoretické části je zaměřena na kriminologickou charakteristiku nejčastěji páchaných trestných činů na mládeži včetně rozboru procesu odhalování a objasňování těchto trestných činů. Další kapitola se zabývá následnou péčí o týrané, zneužívané a zanedbávané děti. A poslední, pátá, kapitola teoretické části je zaměřena na viktimizaci a viktimnost obětí trestných činů páchaných na mládeži. Praktická část bakalářské práce je věnována analýze dat získaných z dotazníku. Po vyhodnocení zpracovaných informací, jsem jednoznačně dospěl k názoru, že trestná činnost páchaná na mládeži je jednou z nejzávažnějších forem kriminality, především z důvodu bezbrannosti jejích obětí a v následcích, které si v důsledku ponesou celý život. Jelikož se jedná převážně o tzv. latentní kriminalitu, je proces odhalování, ale i objasňování, zvlášť obtížný.

Abstract:

The topic of the bachelor's thesis is ‘Detection and investigation of crime committed against young people’. This bachelor's thesis also deals with the most serious and most common criminal offences committed against children. The bachelor's thesis is divided into two parts, theoretical and practical. The theoretical part is divided into five chapters. The first chapter covers the definition and description of basic terms, which are particularly important from the criminal law point of view and which are fundamental for the topic of this bachelor's thesis. The second chapter deals with the state and structure of the crime committed against young people. The third chapter of the theoretical part focuses on the criminological characteristics of the most common crimes committed against young people including analysis of the process of detection and investigation of these crimes. The next chapter deals with the subsequent care of battered, abused and neglected children. The last, fifth chapter of the theoretical part deals with the victimization and precipitation of victims of crimes committed against young people. The practical part of the bachelor's thesis deals with the analysis of data received from a questionnaire. After assessing the processed data, I have come to the firm conclusion that a crime committed against young people is one of the most serious forms of crime, in particular due to the victims' vulnerability and due to consequences these victims bear for the rest of their life as a result of this crime. The detection and investigation process is very difficult, as it mainly concerns the so-called latent criminality.
