Alternative consumer disputes resolution online under the EU law

Abstract:

Tématem práce je mimosoudní řešení spotřebitelských sporů online v právu Evropské unie. Tento způsob řešení sporů by měl poskytovat jednoduché, efektivní, rychlé a levné mimosoudní řešení sporů v souvislosti s online transakcemi. Účelem této práce je zjistit, zda představená legislativní úprava opravdu naplňuje tento předpoklad a zda se tak spotřebiteli dostane adekvátního nástroje pro řešení sporů, které vznikly při elektronickém obchodování. Právě řešení takových sporů totiž bylo identifikováno Evropskou unií jako jedno z klíčových pro další rozvoj vnitřního trhu. Práce v úvodu definuje pojem online dispute resolution. V druhé části je představena konkrétní evropská legislativní úprava, tedy směrnice o spotřebitelském ADR a nařízení o ODR. Pro pochopení celého režimu je demonstrován postup, který musí spotřebitel absolvovat krok za krokem pro to, aby dosáhl vyřešení svého sporu. Dále jsou prezentovány dílčí problémy, které z evropské úpravy plynou a které postupně vyvrací předpoklad, že evropský režim pro řešení spotřebitelských sporů online je vhodně uchopen. Poslední část se pak soustředí na dopady evropské právní úpravy spotřebitelského (online) mimosoudního řešení sporů na český právní řád. Celý přínos evropské právní úpravy dané oblasti je velmi diskutabilní a jedním z cílů práce je prezentovat konkrétní problémy včetně snahy navrhnout možná řešení (pokud je to vůbec možné).

Abstract:

This doctoral thesis is focused on alternative consumer disputes resolution online under the European Union law. Such dispute resolution should provide a simple, efficient, fast and inexpensive out-of-court settlement related to online transactions. The main purpose of this thesis is to determine if the introduced legislation is really fulfilling its aim and if the consumers get an adequate instrument for resolving their disputes arising from electronic commerce. Such area of disputes is in fact identified as one of the key issues hindering further development of the internal market of EU. The thesis in its beginning tries to define online dispute resolution. The second part presents the specific European legislation - the Directive on consumer ADR and the Regulation on ODR. To understand the whole regime, the procedure which the consumers have to complete step-by-step to ensure that they can reach the settlement of their dispute is demonstrated. Problems that stem from European legislation, which gradually refute the assumption that the European system for resolving consumer disputes online is properly grasped, are presented in another part of the thesis. The last part is focused on the impact of European legislation of consumer (online) ADR on the Czech legal order. The whole approach of the European legislation in described area is highly imperfect and one of the goals of the thesis is to present specific issues, including efforts to propose possible solutions (if it is even possible).
