Social Pathological Behaviour of Children in Kindergartens in Náchod and Surroundings

Abstract:

Česká republika po roce 1989 prošla převratnými společenskými změnami. Rok 1989 neznamenal jen změnu politické orientace země. Byla to změna demokratizačního přechodu od jedné politické strany k pluralitě politických stran, demokratizace společenských vztahů, převratnou ekonomickou změnu vlastnických práv a další změny, které byly doprovázeny změnami legislativními. Tyto legislativní změny se dotkly i oblasti trestně právní a tedy i oblasti vývoje práva trestně právní tématiky spojené s dětmi a mládeží. Tento vývoj byl postupný a trnitý, nicméně přijetím zákona o Probační a mediační službě č. 257/2000 Sb., zákona o soudnictví ve věcech mládeže č. 218/2003 Sb. a nového trestního zákoníku č. 40/2009 Sb. ve znění zákona č. 306/2009 Sb. se Česká republika vyrovnala s trestněprávní úpravou sousedních zemí, kde k vývoji docházelo kontinuálně od druhé světové války. Práce je zaměřena na sociální skupinu dětí a mladistvých. Její podstatou je vysvětlení pojmů trestní odpovědnost, jednání jinak trestné, provinění. Současně i vysvětlení pojmů dítě, mladistvý. Součástí práce je i rozbor statistických výkazů oficiální statistiky orgánů činných v trestním řízení. Hlavním cílem průzkumného šetření je zjištění skutečného stavu v oblasti protiprávního jednání dětí a porovnání těchto výsledků s již zmíněnými vykazovanými statistikami. Práce jako celek má odpovědět na dopady provedených změn, jejich vliv na vývoj trestněprávních jednání dětí. Zda skutečně platí, že uvedené změny v citované oblasti jsou na tak dobré úrovni, jak je proklamováno z oficiálně vydávaných statistik.

Abstract:

In Czech Republic, there were big changes after year 1989. This year meant not only change of political system. There were established new political parties, social relationships were democratised, there was a big change in property right and other changes in legislature. These changes in legislature also affected field of criminal law and so also the criminal law connected with children and youth. This process of developing of the law was slow, but passing a bill of probation and mediation service number 257/2000 Sb., Act of justice of youth number 218/2003 Sb. and a new Penal Code number 40/2009 Sb. as amended by the act number 306/2009 Sb. was the Czech Republic up to the Criminal laws of neighbour countries, where the process of developing of the laws was continual since the World War II. The diploma thesis is focused on social group of children and youth. The principle of the work is to clear up words like criminal responsibility, delinquency, offence, as the words such as child, youth and to analyse officially published statistics of organ acting in criminal trial proceedings. The main aim of the research is to find out the real state of unlawful conduct of children and to compare the results with declared statistics. The whole diploma thesis should bring answers for drop of changes in the law, which were done in several last years and the influence of these changes on unlawful conduct of children. I want to find out if it is really truth that the changes are on a high level as it is proclaimed in officially published statistics.
