Abstract:

Fungování trhu není v reálném světě dokonalé. Ve smluvních vztazích je často jedna strana, která má slabší postavení, než druhá. Ve vztazích mezi spotřebiteli a podnikateli je to právě spotřebitel, který nedisponuje dostatkem informací a znalostí. Proto je ve vyspělých státech zařazena do právní úpravy také ochrana spotřebitele. Předkládaná diplomová práce se zabývá ochranou spotřebitele při využívání služeb bankovní sféry. Práce se dívá jak na obecné projevy ochrany spotřebitele v dané oblasti, tak na konkrétní témata, jako jsou bankovní účty, platební styk a spotřebitelský úvěr. Snaží se poukázat na ustanovení zákonů, která mají pro spotřebitele význam, a zhodnotit jejich dostatečnost.

Abstract:

In real world, a market functioning is not perfect. Usually, there is one party in a contract that has weaker position than the other one. In a consumer contract it is a consumer who does not have sufficient information and knowledge. In developed countries, a consumer protection is therefore a part of law regulation. The thesis deals with the consumer protection in banking. It focuses on general topics as well as specific topics, such as banking accounts, electronic fund transfers and consumer credit. It refers to the regulations that has particular meaning for consumer and tries to evaluate if they are adequate.
