Employment Contract and Manifestations of Principle of Autonomy of Will within Commencement of Employment Law Relationship

Abstract:

Tématem této disertační práce je pracovní smlouva a projevy autonomie vůle smluvních stran při vzniku pracovního poměru. V souladu s primátem jmenované vůdčí soukromoprávní zásady při uzavírání pracovní smlouvy jsou prezentovány její konkrétní projevy v jednotlivých rovinách. Manifestace autonomie vůle smluvních stran pracovního poměru jsou dále detailně analyzovány ve vztahu k jak obligatorním, tak vybraným obvyklým fakultativním náležitostem pracovní smlouvy (jež jsou diferencovány na formativní a komplementární). V předmětných oblastech si práce klade za cíl detailně analyzovat a identifikovat, jakými konkrétními způsoby dochází k realizaci autonomie vůle smluvních stran pracovního poměru při uzavírání pracovní smlouvy.

Abstract:

This dissertation focuses on the employment contract and manifestations of the autonomy of the will of the contracting parties within the commencement of an employment relationship. In accordance with the primacy of the named guiding principle of private law in the area of concluding an employment contract, its particular manifestations are presented in its distinguished dimensions. The manifestations of the autonomy of the will of the parties of the employment relationship are further analysed in detail in relation to both obligatory and selected customary voluntary requirements of the employment contract (which are categorized into formative and complementary ones). In all the differentiated areas in question, the dissertation aims to deeply analyse and identify the specific ways in which the autonomy of the will of the parties of the employment relationship is realized when concluding the employment contract.
