Abstract:

Cílem této práce je přiblížit problematiku mezinárodního zdaňování fyzických osob. S tímto problémem se setkáváme v každodenním životě velmi často. Každá osoba je nucena ze svého příjmu odvádět určenou daň dle sazebníku dané země a díky možnosti výdělků ve více zemích zároveň je nutné stanovit, jak budou příjmy poplatníka zdaňovány. V teoretické části se zabývám vymezením základních pojmů, především provázanost lokálních daňových předpisů se smlouvami o zamezení dvojího zdanění a vznik daňového domicilu. Také zmíním všechny metody, dle kterých dochází k zamezování dvojího zdanění. V praktické části jsem se zaměřil na problematiku migrace zaměstnanců mezi jednotlivými státy a na případy, kdy dochází ke vzniku stále provozovny v České republice a za jakých podmínek. Na závěr práce uvedu praktické příklady využití metod zamezení dvojího zdanění.

Abstract:

The aim of the analysis is to give an insight into the issue of international taxation of natural persons which is a matter that can arise in our daily lives. Every person is required to pay from her/his income prescribed tax in accordance with the rates set by relevant country. On the contrary, taking into account the possibility of income originating from different countries, it is necessary to set down the way in which the international incomes will be taxed. In theoretical part, I examine the definitions of fundamental terms, particularly the interconnection of national tax legislation with the Double Taxation Prevention Treaties and the origin of tax domicile. I also analyze the methods which are used to prevent the double taxation. As concerns the practical part, I focus on the migration of employees among individual countries and on the cases and conditions under which the permanent business premises are established in the Czech Republic. Finally, I give several practical examples of the application of the methods used to prevent the double taxation.
