Recusal of Judges in the Practice of Czech Supreme Courts

Abstract:

Disertační práce se zabývá tématem vyloučení soudce pro podjatost v rozhodovací praxi českých vrcholných soudů. Práce analyzuje právní úpravu vyloučení soudce pro podjatost, postup při rozhodování o vyloučení soudce a jednotlivé důvody podjatosti vyplývající ze zákona či judikatury. Práce se blíže zaměřuje na zvláštnosti vyloučení soudců vrcholných soudů, které mají omezený počet členů a jejich pravomoc nelze přenést na jiný soud. Praktická část práce pracuje s obsahovou analýzou rozhodnutí Ústavního soudu, Nejvyššího soudu a Nejvyššího správního soudu vydaných v letech 2013 – 2019 týkajících se vyloučení soudců pro podjatost. Práce analyzuje, které důvody podjatosti jsou v praxi nejčastěji namítány, jaká je jejich úspěšnost a kde leží hranice mezi skutečnostmi zakládajícími v praxi podjatost soudce a skutečnostmi, které naopak k vyloučení soudce zpravidla nevedou.

Abstract:

The subject of this thesis is the recusal of a judge in the case-law of Czech supreme courts. The thesis analyses the legal framework and decision-making process of the judicial disqualification and the individual grounds of bias arising from the law or case-law. The thesis focuses on the specifics of the judge's recusal in supreme courts, which have a limited number of members and their powers cannot be transferred to another court. The practical part of the thesis uses content analysis of the decisions concerning the recusal of judges for bias issued between 2013 and 2019 by the Constitutional Court, the Supreme Court, and the Supreme Administrative Court. The study evaluates which reasons of bias are the most objected, how successful they are, and where lie the boundaries between the circumstances which cause bias of the judge and the facts that, on the other hand, usually do not lead to the disqualification of the judge.
