Bitcoin: Regulation in the EU

Abstract:

Tato diplomová práce se zabývá regulací Bitcoinu v Evropské unii. Rostoucí popularita kryptoměn v posledních letech donutila regulátory k tomu, aby se právním postavením kryptoměn začali pozorně zabývat. Kryptoměny pro ně ale díky svému decentralizovanému systému představují velkou výzvu. O to větší, že mají globální dosah, to znamená, že neznají státní hranice. Jednotlivé země po celém světě zaujaly k otázce regulace kryptoměn různé přístupy – od jeho zákazu až po přijetí jako legálního platidla. Nicméně většina vlád se stále rozhoduje, jakým způsobem ke kryptoměnám přistoupit. Evropská unie se k virtuálním měnám poprvé oficiálně vyjádřila v roce 2012. Tehdy Evropská centrální banka vydala dokument s názvem „Schémata virtuálních měn“, ve kterém poprvé definuje virtuální měny. Nicméně Bitcoinu se dostalo větší pozornosti ze strany unijních zákonodárců až v souvislosti s teroristickými útoky v Paříži v roce 2015. Na základě analýzy právních dokumentů EU je cílem práce zjistit, zda v Evropské unii existuje jasná strategie v regulaci kryptoměn. Práce dále porovnává přístupy tří členských států EU k regulaci kryptoměn – České republiky, Německa a Velké Británie – a na základě jejich podnikatelského prostředí rozhodnout, kde je nejvýhodnější podnikat v oblasti kryptoměn.

Abstract:

The theme of this diploma thesis is the regulation of Bitcoin in the European Union. Cryptocurrencies were founded on the principles of decentralization, which creates a challenge for lawmakers around the world. The aim of the thesis is to decide, whether there is a clear strategy on how to regulate cryptocurrencies in the European Union. The main chapter of this thesis is focused on analyzing the legal documents directly regulating, or otherwise affecting cryptocurrencies in the European Union. The very first time an EU institution has acknowledged cryptocurrencies in any formal manner was in 2012, when the European Central Bank released a report on Virtual Currency Schemes. At the same time, it was the first attempt at their legal categorization and definiton. Another aim of the thesis is to analyze the nature of the regulatory approach towards cryptocurrencies in the Czech Republic, Germany and The United Kingdom, and decided which country has the best conditions to launch a cryptocurrency business there.
