The part of constitutional courts in the states of Central Europe and their coping strategies with the totalitarian past

Abstract:

Diplomová práce se zaměřuje na to, jak se státy střední Evropy, zejména pak na ústavněprávní úrovni, vyrovnaly se svou komunistickou minulostí. Stěžejmími státy pro tuto práci byly Česká republika, Polsko, Maďarsko a bývalá Německá demokratická republika, dnes Spolková republika Německo. Práce se zaměřuje na hlavní problematické aspekty těchto zemí při jejich přeměně v demokratický právní stát, popisuje vývoj a vznik nových ústav a zaměřuje se přitom na institutci ústavních soudů. Práce se také snaží odpovědět na otázku rehabilitací, restitucí, lustračních zákonů a ilegality komunistického režimu vůbec.

Abstract:

The diploma seeks the answer how the states in Central Europe have coping with their totalitarian past. The work targed the constitutional aspects. The main countries, about the work has been writed, are Czech republic, Poland, Hungary and Germany. The diploma handels with the main problems by transformation of the states of Central Europe into a democratic society, describes the evolutin of the Constitutions, also the Constitutional Courts and their sense. The dissertation also tries to answer questions about exonerations, restitutions, lustration also about the illegality of the comunism regime.
