Legal Protection of the Debtor and the Third Parties at the Enforcement Proceedings

Abstract:

Cílem diplomové práce je vymezit možnosti ochrany povinného a třetích osob v rámci exekuce. Nejdříve je obecně definována ochrana vlastnického práva a zásady exekučního řízení. Následuje přehled jednotlivých institutů týkajících se dané problematiky, a také návrh nové právní úpravy, tedy úvahy de lege ferenda. Pozornost je věnována především vylučovací žalobě a vztahu mezi vyškrtnutím věci ze soupisu a vylučovací žalobou.

Abstract:

The aim of this thesis is to determinate possibilities of legal protection of the debtor and third parties at the enforcement proceedings. Firstly, is defined protection of rights in property and principles of execution. The following is an overview of individual institutes that are related to the topic of this thesis, and also a proposal of new legislation, thus consideratons on the possible changes of the current legislation. Attention is paid mainly to action to extempt a claim from the execution of judgement and connection between motion to striking out claim from the list and action to extempt a claim from the execution of judgement.
