Trade Name as an Object of Industrial Property Right

Abstract:

Práce pojednává o právní úpravě práva k obchodnímu jménu jako subjektovému označení podnikatele, pod nímž podnikatel realizuje svoji podnikatelskou činnost v souladu s právem na území konkrétního státu, a to ve smyslu čl. 8 Pařížské úmluvy. Při výkladu uvedeného ustanovení byly vedle systematického a teleologického výkladu Pařížské úmluvy zohledněny též závěry orgánů WTO a SDEU k výkladu Dohody TRIPS, jež obsahuje závazek dodržovat čl. 8 Pařížské úmluvy. Pro ilustraci regulace práva k obchodnímu jménu v sousedních zemích práce pokračuje zahraničním exkurzem do právní úpravy účinné na Slovensku, v Rakousku a v Německu. Práce navazuje rozborem kolizních norem určujících mezinárodně příslušné soudy států a právo rozhodné ve sporech s mezinárodním prvkem vzniklých z porušení práva k obchodnímu jménu protiprávním mimosmluvním jednáním třetích osob. V závěru se pak práce věnuje zejména otázce, zda Česká republika chrání právo k obchodnímu jménu na svém území správně.

Abstract:

The thesis deals with the legal regulation of the right to a trade name as the subject designation of an entrepreneur under which the entrepreneur carries out his business activities in accordance with the law in the territory of a particular state, in the sense of Art. 8 of the Paris Convention. In interpreting that provision, in addition to a systematic and teleological interpretation of the Paris Convention, account was also taken of the conclusions of the WTO and CJEU authorities on the interpretation of the TRIPS Agreement, which contains an obligation to comply with Art. 8 of the Paris Convention. To illustrate the regulation of the right to a trade name in neighbouring countries, the thesis continues with a foreign excursion to the legislation of Slovakia, Austria, and Germany. The thesis then contains an analysis of the conflict of laws rules determining the internationally competent courts of the states and the law applicable in disputes with an international element arising from the infringement of trade name rights by unlawful non contractual conduct of third parties. And finally, the thesis focuses on the question whether the Czech Republic protects the right to a trade name on its territory correctly.
