Abstract:

Tématem této bakalářské práce je seznámení s institutem Smlouva o postoupení pohledávky. Zprvu se věnuji obecně pojmu změna závazkových právních vztahů a podstatě postoupení pohledávky. První část práce obecně podává právní vymezení a náležitosti smlouvy, která umožňuje postoupení pohledávky dle občanského zákoníku, zákon č.89/2012 Sb. Následující část práce sleduje využívání smlouvy o postupování pohledávek v praxi a to v bankovní i nebankovní sféře.

Abstract:

The subject of this bachelor's dissertation is to introduce the institute to a Contract for the Assignment of Receivables. First, I focus generally on the concept of changes in obligatory legal relations and on the essence of the assignment of receivables. The first part of the paper presents a general legal definition and general requirements of the contract which allow the assignment of receivables under the Civil Code, Act No. 89/2012 Coll. The subsequent part of the dissertation monitors the use of the Contract for the Assignment of Receivables in practice in both the banking and non-banking sectors.
