Legal Protection of Elephants

Abstract:

Tématem této kvalifikační práce je ochrana slonů na mezinárodní, unijní a vnitrostátní úrovni. Cílem je určení, jakým způsobem právo přispívá k ochraně těchto tvorů a zdali je právní úprava dostačující. Pokud je shledána jako nevyhovující, je práce doplněna návrhy de lege ferenda. Analyzovaná je právní úprava týkající se ochrany jak volně žijících slonů, tak i těch chovaných v lidské péči. Nejdříve jsou rozebrány mechanismy regulující obchod se slonovinou a částmi těl slonů. Dále je analyzovaná právní úprava chránící tato zvířata v místě jejich přirozeného výskytu. V neposlední řadě se práce zabývá aspekty, které chrání slony chované v cirkusech a zoologických zahradách. Součástí diplomové práce jsou zahrnuté informace získané od státních orgánů na ochranu zvířat.

Abstract:

Presented thesis deals with the topic of protection of elephants at international, EU and national level. The main objective is to determine how the law contributes to the protection of these creatures and whether the legislation is sufficient. If it is found to be unsatisfactory, the work is accompanied by proposals de lege ferenda. The legislation concerning the protection of both wild elephants and those kept in human care is analyzed. Discussed mechanisms regulating trade in ivory and parts of elephant bodies are followed by analysis of legislation protecting these animals in the place of their natural occurrence. The thesis also focuses on aspects that protect elephants kept in circuses and zoos. The work is accompanied with information obtained from the state animal protection authorities.
