Abstract:

Hlavním tématem bakalářské práce je řízení o udělení patentu v České republice. Patent je způsob právní ochrany vynálezu, který splňuje poţadavky na jeho udělení dané zákonem č. 527/1990 Sb. o vynálezech a zlepšovacích návrzích, ve znění pozdějších právních předpisů. Vynález musí být nový, výsledkem vynálezecké činnosti a průmyslově vyuţitelný. Přihláška vynálezu o udělení patentu se podává na předepsaném formuláři se všemi podlohami a přílohami, jejich úprava a obsah je přesně stanoven příslušnými zákony, směrnicemi a nařízeními. Po doručení přihlášky na Úřad průmyslového vlastnictví v Praze se zahajuje řízení o udělení patentu, má několika na sebe navazujících částí: předběţný průzkum, rešerše, uveřejnění přihlášky ve Věstníku, úplný průzkum, udělení patentu nebo zamítnutí. Tento proces je dán zákonnými lhůtami. Podrobněji jsou tyto otázky řešeny v druhé a třetí kapitole. Přihlašovatel se můţe sám rozhodnout, zda přihlásí svůj vynález i v jiných státech, a to cestou národní přihlášky, nebo přes Úřad průmyslového vlastnictví, a to cestou mezinárodní přihlášky PCT, nebo cestou evropského patentu. Toto téma je popsáno ve čtvrté kapitole. V páté kapitole jsou uvedeny vybrané statistické údaje za období posledních deseti let v oblasti podaných přihlášek a udělených patentů.

Abstract:

This bachelor work deals with the patent application procedure in the Czech Republic. The patent is a special document giving the right to make or sell a new invention or product that no one else is allowed to copy. The patent protects the invention legally and to be granted it has to meet the requirements of the Law No. 527/1990 Sb. (on the statute book) About inventions and innovations, as subsequently amended. The invention has to be new, has to result from research and has to be industrially useable. The patent application is filed on the prescribed application form with all supplements and enclosures whose layout and content is given by relevant laws, regulations and instructions. After the patent application is delivered to The Office of Industrial Property in Prague, the patent procedure is started. The procedure includes several successive parts: preliminary exploration, research, publication of the application form in bulletin, detailed research and granting or refusing the patent. The procedure follows the periods of time given by law. These questions are presented in a greater detail in the second and third chapters. The applicants can decide if their invention will also be lodged in other countries, either using the national application form or via The Office of Industrial Property by the international patent application form PCT or as the European patent. A detailed description is given in the fourth chapter of this work. In the fifth chapter there are selected statistical data from the period of the last ten years, stating the filed patent application forms and the granted patents.
