The Definition of the Concept of Investment under the Article 25 ICSID

Abstract:

Tato práce se zabývá pojetím pojmu investice ve smyslu čl. 25 Úmluvy Mezinárodního centra pro urovnávání investičních sporů (ICSID). Díky absenci přesného vymezení tohoto pojmu v rámci textu Úmluvy je na tribunálech sestavených dle pravidel ICSID, aby při aplikaci co nejlépe odstínili předmět a účel Úmluvy. Nyní je necelých 50 let od vzniku ICSID a cílem této práce je zjistit, zda se rozhodčím tribunálům úspěšně podařilo obecně platnou definici tohoto pojmu.

Abstract:

This thesis deals with the conception of the term investment with respect to Article 25 of the ICSID Convention. Due to the absence of an exhausting definition of this term within the text og the Convention, it eventually became inevitable for the tribunals to correct this absence in their case law. . It has been nearly 50 years since the adoption of the Convention and this thesis makes sure to examine all the significant case law, in order to support, or dispove the existence of an obligatory definition of the term investment in respect to the Art. 25 of the Convention.
