Odvolání jakožto řádný opravný prostředek v trestním řízení

The Appeal as Regular Correcting Fund in the Penal Proceeding
Abstract:
Diplomová práce se zabývá postavením odvolání jako řádného opravného prostředku v trestním řízení. Vymezuje pozici tohoto institutu v rámci českého práva a popisuje související postupy účatníků řižení i soudů na základě analýzy platných předpisů a judikatury Nejvyššího a Ústavního soudu ČR. Součástí práce je také srovnání se slovenskou úpravou a návrhy de lege ferenda.
Abstract:
This thesis deals with possition of appeal as regular correcting fung in penal proceeding. It defines its status in Czech criminal law and describes related procedures of parties as wel as courts based on analysis of aplicable law and case law created by High Court and Constitutional Court of Czech republic.
