Responsibility to protect: an analysis of the trasformation of the concept of sovereignty after the end of the Cold War

Abstract:

Státní suverenita je jedním ze základních principů mezinárodní politiky a mezinárodního práva. Evropské státy se jejími principy řídí již od poloviny 17. století a díky jejich vlivu se suverenita stala mezinárodní normou. Avšak koncept suverenity není neměnný. Právě zmapování a analyzování proměn konceptu suverenity je cílem této práce, a to od jeho vzniku po současnost. Práce klade důraz na srovnání pojetí konceptu suverenity před a po konci studené války, neboť právě v období po skončení studené války prošel koncept suverenity zásadní proměnou. V tomto období došlo k ústupu od absolutního pojetí státní suverenity směrem k možnosti narušení státní suverenity v případě, kdy státy selžou v ochraně vlastních obyvatel před genocidou, válečnými zločiny, etnickými čistkami a zločiny proti lidskosti. Díky snaze o zabraňování humanitárním krizím během vnitrostátních konfliktů došlo k redefinování konceptu suverenity tak, aby OSN neporušovala vlastní pravidla o nevměšování se do vnitřních záležitostí států. Tato redefinice byla formálně potvrzena přijetím konceptu Odpovědnost za ochranu na světovém summitu OSN v roce 2005. Přijetí konceptu Odpovědnost za ochranu lze označit za vítězství zastánců doktríny humanitárních intervencí, protože od jeho přijetí jsou členské státy OSN oprávněny k intervenci do vnitřních záležitostí států za účelem ochrany lidských práv.

Abstract:

State sovereignty is one of the fundamental principles of international politics and international law since the 17th century. However, the concept of state sovereignty is not constant. For this reason, it is important to note the changes of the concept of state sovereignty from the formation of the concept to the present. The main objective of the work consists of comparing the concept before and after the end of the Cold War, because in the decade after the end of the Cold War the concept of sovereignty has undergone major changes. This thesis explains the reasons and causes which enabled the change in the concept of sovereignty; a retreat from absolutist conception of state sovereignty which has been a central and enduring feature of international relation since the consolidation of the nation-state system. Yet since the 1990s the concept of sovereighnty is changing as a result of the international policies of states that express the underlying beliefs about legitimite state behavior. Since 1990s there has been a move away from the absolutist notion of sovereignty toward the possibility of disruption of state sovereignty in certain states if the crimes against the local population are committed there; particularly crimes of genocide, war crimes, ethnic cleansing and crimes against humanity. This was faciliated by the adoption of the concept of Responsibility to Protect in 2005 when the international community formally confirmed the change in perception of sovereignty.
